It is, in essence, a Constitutional amendment (changing the functional operation of the Legislature) that did not go through the amendment process. No Congress shall be bound by the actions of a previous Congress.

Congress cannot change the Constitution by itself ... so any such change would be unconstitutional and not binding on a subsequent Congress.
