Fourteen States Have Filed Lawsuits
On Tuesday, Virginia’s attorney general Ken Cuccinelli filed a lawsuit challenging the health care bill. Thirteen other states have banded together to file a lawsuit — Florida, South Carolina, Nebraska, Texas, Michigan, Utah, Pennsylvania, Alabama, South Dakota, Louisiana, Idaho, Washington and Colorado. Those thirteen attorneys general are mostly Republicans, but one is a Democrat. Their spokesperson is the very personable Bill McCollum of Florida.
At issue will be whether Congress has the power to treat as “interstate commerce” the actions of a citizen who hasn’t purchased anything, and whether Congress has the authority to order citizens to buy any product:
“Never in this nation’s history has the commerce power been used to require a person who does nothing, to engage in economic activity,” said Professor Randy Barnett of Georgetown University Law Center.
Mandating that all Americans purchase health insurance is akin to “requir[ing] every American to buy a new Chevy Impala every year,” to help the automobile industry, Barnett said.
More to the point, large numbers of Americans do not choose traditional health care. Many use alternative modalities, and many rely on prayer. So forcing them to buy traditional health insurance is like forcing people who only drink tea to buy a coffee pot.
