MONTPELIER, Vt. – The birth mother of a 7-year-old Virginia girl must transfer custody of the child to the woman's former lesbian partner, a Vermont judge ruled, adding that it seems the woman has "disappeared" with her daughter...

..The couple broke up in 2003, and Miller moved to Virginia, renounced homosexuality and became an evangelical Christian...

I’d do some judge hanging.

A few years ago Sandra Day bitched about judges taking heat unfairly for their decisions. Being fearful.
I disagree. I want the bastards nervous. I want them held accountable for their horse crap decisions.
Burn some at the stake.

I wonder if the birth mother will be forced to pay child support?

"Your constitutional rights are waivable when you are a parent. "

I'm certainly not defending the flawed abomination that (in some jurisdictions) has become America's domestic and family system. But, in the interest of fairness, the court does have a difficult mission - it must decide contentious issues while weighing the rights of mother, father and child - and hopefully, it will find accommodation that is ultimately in the best interest of the child.

In America, we have an adversarial legal system. I wouldn't have it any other way. Unfortunate, when two adversaries do battle, one usually loses. As long as due process is adhered to, that is really all that a civil society can ask for.

She has legal full custody in Virgina and IMHO Vermont has no buisness butting into the matter!

From the article - "The supreme courts of Virginia and Vermont ruled in favor of Jenkins..."

(Jenkins being the remaining thespian in VT)

Will Virginia law enforcement staff have to enforce this unconstitutional ruling and take the child from her mother?

I hope you never experience all that "due process" can encompass when it comes to child protective services at your door. You might indeed wish you could have it any other way.

Given what the Law of Moses says about Homosexuality, I don’t have to wonder what Solomon would have done.

Beat me to it... I was going to look up the passages (Leviticus 18 has one of them, I believe) - but you pretty much said it. No doubt as to what Solomon would have done.

Not my fault...

'Birth mom' worked amazingly well. But I'm lucky like that.

"I hope you never experience all that "due process" can encompass when it comes to child protective services at your door."

Well, my kids are all in their '20s. So, if CPS shows up at my door, my wife has some explaining to do.

Be that as it may, CPS has one of the most thankless jobs in the country. They are damned if they do, and damned if they don't. The Constitution protects all the citizens, to include our minor citizens. And, sometimes that means protection for a child from their own parent(s).

That also means that sometimes, perhaps even frequently, CPS is used as a legal tool for leverage against one parent by the other. That's not necessarily the fault of CPS, but is probably more reflective of the acrimony that is all to often present in America's broken homes.

..access to the other mother..

How does that even compute? I agree that by "recognizing/condoning" homosexual unions, the justice system will reap the whirlwind, but why not use some gender neutral terms that do not conflict with nature and common sense.

Spousal unit, coupling member, or parental partner all are preferable to calling a woman-never-having-conceived "mother"; otherwise is nonsense.

I feel sorry for the child , but have no sympathy for either woman.

The child should stay with the birth mother unless she is totally unfit. The Dyke she was married to has no “standing” IMO.

Of course when you are dealing with Fruits in a State that loves Fruits anything is possible.

I'm with you. Judges disgust me anymore. They're more often than not black-robed demagogues and tyrants, given to enforcing ideology instead of law. I'd delight in seeing a few of them drug through the streets.

It’s not from the same source, so I didn’t expect it to be taken as a slam. It’s just another thread where the same issue is being discussed. Some folks might want to see the comments on the other thread too.

Her bad decisions (and horrendous they were) in her past is beside the point. The child has shown distress at having to visit the “other mom” - hence the reason the visits were stopped.

You have no protection, no inalienable rights. The child protective services have the power to enter your home, remove your children, remove YOU if they wish.

This is perhaps the most overlooked abrogation of natural, God-given rights infecting this country right now - no less odious than the gun grabbing, vote stealing, and speech squelching practiced by Democrats. Yet another good reason for an all-out civil war and destruction of the liberal, PC bureaucracy in power.

This is Vermont, almost California!

Hey now, we outlawed that gay marriage crap in California, so we're a step above Vermont.
