To: Non-Sequitur

Oh, I thought Kenya was the latest location du jour of his birth.

I’ve read he was born in Hawaii to parents who were non-citizens, and I’ve read he was born in Kenya.

I wonder if he fits one of these-

Currently, Title 8 of the U.S. Code fills in those gaps. Section 1401 defines the following as people who are “citizens of the United States at birth:”

Anyone born inside the United States *
Any Indian or Eskimo born in the United States, provided being a citizen of the U.S. does not impair the person’s status as a citizen of the tribe
Any one born outside the United States, both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S.
Any one born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national
Any one born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year
Any one found in the U.S. under the age of five, whose parentage cannot be determined, as long as proof of non-citizenship is not provided by age 21
Any one born outside the United States, if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time)
A final, historical condition: a person born before 5/24/1934 of an alien father and a U.S. citizen mother who has lived in the U.S.

I’m so sick of you folks who cannot seem to understand that there is a difference between a “citizen” and a “natural born citizen” (which is what the Constitution requires for someone to be President).

I’m a perfect example. I’m a citizen due to my being born in California. But I’m not a natural born citizen because my father wasn’t a citizen at the time I was born (and the country of which he was a citizen recognized the citizenship of children, so I was born with dual citizenship).

So stop trying to use these inane arguments about whether Obama is a citizen to confuse and muddy up the issue. It’s not about his citizenship, it’s about whether or not he’s a natural born citizen. (Although even his “plain old” citizenship is on shaky ground as a result of the questions about his traveling on foreign passports that have come up, and never been addressed.)

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President.

The definition of the term, “natural born citizen”, was entered into the Congressional record of the House on March 9, 1866, in comments made by Rep. John Bingham on the Civil Rights Act of 1866, which was the precursor to the Fourteenth Amendment. He repeated Vattel’s definition when he said:

“[I] find no fault with the introductory clause, which is simply declaratory of what is written in the Constitution, that every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen. . . . ” — John A. Bingham, (R-Ohio) US Congressman, March 9, 1866 Cong. Globe, 39th, 1st Sess., 1291 (1866), Sec. 1992 of U.S. Revised Statutes (1866).
