WASHINGTON The Justice Department has concluded that the Obama administration can lawfully pay the community group Acorn for services provided under contracts signed before Congress enacted a law banning the government from providing funds to the group.
The departments conclusion, laid out in a recently disclosed five-page memorandum from David Barron, the acting assistant attorney general for the Office of Legal Counsel, adds a new wrinkle to a sharp political debate over the antipoverty groups activities and recent efforts to distance the government from it.
Mr. Barron said he had based his conclusion on the statutes phrase provided to. This phrase, he said, has no clearly defined meaning in the realm of government spending unlike such words as obligate and expend.
Citing dictionary and thesaurus entries, he said provided to could be interpreted as meaning only instances in which an official was making discretionary choices about whether to give the group money, rather than instances in which the transfer of funds to Acorn was required to satisfy existing contractual obligations.
Since there are two possible ways to construe the term provided to, Mr. Barron wrote, it makes sense to pick the interpretation that allows the government to avoid breaching contracts. ...

Can you imagine a USA with unlimited opportunity again? Let the people homestead, drill, produce, and prosper. If one of your neighbor is polluting the streams, get your neighbors together with a noose. That problem will go away. Men and women just want to be free. Excellence and initiative may once again be rewarded.
FedEx and UPS can bid for mail delivery (competition is good, you know), and the only other Constitutional mandate is to secure our borders. We can help others, but we will fence our borders, and arm our citizens. Those who don't produce will die. The truly needy will always be covered by true charity, but the takers will forage and dwindle. Many will loot and pillage. The states can each take care of their own criminals. Local Sheriff's will once again be the law, and courts may once again become equitable (Kelo??????)

How can the Attorney General dictate where Congressional money is allocated?
Congress holds the purse strings.
Wouldn’t this be a violation of the Constitution? A dictate from the executive branch on powers reserved for Congress?
Only if the GOP have the balls to continue the fight. All too often, the GOP lets the left off easy, claiming it is time to move on and get past the bad time and come together. And this is all BS. Once we reclaim power, we must expose and degrade the left and all thier minions. Put a boot on thier neck and keep them down, like the allies should have done to Germany after ww1.
If the GOP has the guts to do it.
