I'd say that he's an enemy combatant ... and that he was wearing our uniform while engaged in direct action against us. That makes him a spy, IIRC ... seems to me The Army can just put him up against a wall and shoot him.
At the very least, he should be sent to GITMO, to be incarcerated with his brethren.
