“In the Military, you are Guilty until proven Innocent”

That is an oft-quoted slander. First, read Article 32 of the UCMJ. A defendants rights are more clearly defined than they ever were in civilian courts, and a generation before Miranda.

Secondly, having served on both courts-martial and civilian juries, I'd far rather take my chances with soldiers over civilians, particularly if I was innocent.

Lastly, since the Manual for Courts-Martial clearly outlines what the elements of an offense are. No JAG will recommend a Commander convene a court unless the evidence is pretty solid. That is what accounts for the generally good conviction rate; not going to trial with a flimsy case and lousy evidence.

I stand corrected on the Military Court “Guilty until proven Innocent” quote.
But as you said, this perception arises out of the Jags ......

These are not mutually exclusive alternatives. The perp could be in jail with various horny friends and neighbors for a while as his conviction goes through the inevitable stages of review. Maybe his 70 or so virgins will get their rocks off on him even before he goes to mohammedan heaven. Depends what you mean by virgins!

Won’t zero need to okay the scum’s execution?

The prisoner who has been on the military death row the longest was sent there in 1988. Hassan could be convicted tomorrow and it'll be decades before he's executed. Long after Obama has left office.

Prisoners on federal death row occasionally get executed. The last military prisoner execution was almost 50 years ago.
