"(g) The commission or election board shall deny a filing if the commission or election board determines that the candidate has not complied with the applicable requirements for the candidate set forth in the Constitution of the United States, the Constitution of the State of Indiana, or this title. "

OK, great. So let's say Obama files the paperwork and swears he is eligible.

This only requires the commission or elections board to deny filing if they determine he is not eligible. Has the commission or election board determined that? Does it say a birth certificate is required to comply?

That’s my whole point. The plaintiff is barking up the wrong tree. The secretary of states are liable. I don’t see any way around it. I won’t accept a sworn statement from some nurse that just might now pop up and say she was in hawaii when he was born. Aint gonna work for me. Documention that is proven legit would satisfy my ‘curiousity’ so to speak. In addition, Alan Keyes has a valid complaint. I wish he would start with his state’s secretary of state...see the results of their vetting. My bet on the vetting, is that it will lead to the dnc, who should also be a defendant. :)
