I just received a call from Orly Taitz, my attorney in the case seeking proof of Obama's eligibility for the Office of President of the United States. Judge Carter has released a statement declaring that the dates he set for the hearing and trial on the eligibility issue are confirmed, and it will move forward as scheduled. Apparently he was not swayed by the Obama lawyer's arguments.
Why that raises quite a conundrum since John McCain was born in Panama and by that fact is not a Natural Born Citizen.
So, according to you and your constitutional lawyer, Obama, McCain, Biden and Palin are not eligible.

Byrd is the only person with clean hands after the election.
Which means Biden would be Marcy Parked.

If Obama is declared not qualified for the presidency, that would invalidate everything he did while usurping the office, including his cabinet appointments. Goodbye Hillary!.
The succession amendment has only two positions (three if Biden is in fact qualified himself) that are not appointed by the president. Speaker of the House (Pelosi) and President Pro Tem of the Senate (Byrd). Pelosi would be in legal trouble due to vetting an unqualified candidate and Byrd would cause the riot to end all riots.
We're in for Big Trouble no matter what happens.
If the case actually does go through, I'd expect Obama and Biden[1] to be thrown under the bus before any wrong doing can be decided in court (thus freeing Pelosi) and President Pelosi immediately pardoning Obama/Biden and probably issuing an executive order restoring legislation that Obama signed.
We survived an unelected Ford/Rockefeller administration and we would survive an unelected Pelosi/??? administration. I'm just not sure how well we'll survive an Obama/Biden administration.
[1] There's been a term for all Democrat VP candidates since LBJ - "Life Insurance for the President".
I don’t think it reads ‘if the nominee shall fail’ ... and an ineligible nominee cannot be an eligible Pres_ _ent failing to qualify, IMHO.

My thoughts exactly. Nothing here gives any indication that the Motion To Dismiss will be denied. In fact, both Taitz and Kreep (who was an hour late for the hearing - thanks Gary ! ) stated that they saw a ‘different’ Judge Carter on Monday than in prior hearings.
NOTHING would please me more than to have discovery ordered, but my take is that Carter is under incredible pressure to not proceed with this case. I hope to God I am wrong.
BTW, if discovery is ordered, the Defendants will only appeal that decision anyway, so this could take a long time
to resolve.
I am hopeful that Leo’s requests, (which are 100% legit) will SOMEHOW reveal SOMETHING about this Mystery Man.

Indeed. The U.S. could then (by statue) rule that all Iranian’s (& thus previous U.S. Citizens) are now U.S. citizens...and make it retroactive. It’s a meaningless hypothetical.
If Biden was made prez through the ouster of Obama and the Dems were dealing with having totally screwed the American public, I would guess they would not be making much “progress” from that point on.

Why would Joe be disqualified? He is natural born from all appearances.
This is an important feature because K-records for original school entry would have contained the following:
1. His REAL Birth Certificate.
2. An application with the following:
—1. His Legal name.
—2. Parents or Legal Guardians’ names.
—3. Date of Birth
—4. Place of Birth
—5. Vaccination Records
(revealing a timeline to the place and DOB.)
It also is important for two reasons:
A. The Dept. of Education does not “lose” the records of one particular student. (Who paid whom what sum to make this record disappear?)
B. There would have been NO shameful low-test scores, NO embarrassing Equal Opportunity advancements, and NO trails of fraudulent funding to hide which could possibly ‘excuse’ the quashing of public school Kindergarten entry records.
For the rest of his life he attended very expensive private schools and has had his records legally sealed to deny the public, his true life story.
This is different. Hawaii should be able to verify he attended their school since he is featured in class photographs. State and federal tax dollars paid for his initial year of education. Why is there no documentation?
This is the ‘tip of the iceberg’ of an intentionally erased life of a fraudulent conman and it reeks of complicity by officials within the State of Hawaii’s Dept. of Health & Dept. of Education.

I disagree.. Obama’s ‘ability to discharge the powers and duties of his office’ is not at issue.
If the Supreme Court were to rule that the Act of Congress selecting Obama was not constitutional, then the Electoral College vote for the position of President is null, and the occupant of the position prior to that Congressional vote would still be president.
Congress would then be required to vote again from among the qualified candidates. The qualified candidate receiving the most votes would seem to be the likely selectee, but it has been discussed at length in the recent past that the Electoral College process has the freedom and liberty to select qualified American citizen for the position.
So potentially, Bush could still be President, until the Electoral College can select from the entire national population of qualified citizens.

He was elected under false pretenses.
McCain has already been vetted and certified. He was born on a US military base with both parents being US citizens.
The amendment speaks directly to the case (like this one perhaps) where the president fails to qualify. Biden would not be affected by that situation.
Sadly, no, Bush would not still be president since the Constitution specifies when his term ended.
Yes, here comes the Defense’s motion to appeal any discovery.
