Sorry, I don’t have the time to address all of your issues and questions. My purpose in posting #948 was to stop you from claiming that the original 1963 constitution referred to Kenya as a “Republic” when apparently it did not. (In general, I don’t like to see persons posting inaccurate information. Just a pet peeve of mine, I suppose.)

I see. There are two versions linked below. The earlier version, apparently circa 12-1963 (based on dates in the text of the document), that doesn’t refer to ‘Republic’ and a later version, which is dated 1963 in the title, and which *does* refer to ‘Republic.’ My very clear question is when did the second document, without its amendments, get written? It seems logical that since it was dated 1963, it was originally written in 1963 - something of a second draft. I’m speculating, of course, and I asked others their opinion - still allowed by you?

I'll be as succinct as possible. The second document that you listed is the 2008 version of the constitution. The presence of "1963" means that the constitution dates back originally to 1963, not that it's a 1963 version. The page you listed and the document itself clearly state "as Amended to 2008".

To answer your question "when did the second document, without its amendments, get written?" you'd have to compare every version of the constitution. Apparently, there was a major reorganization at some point. Do I think it happened in 1963? No. Two reasons: (1) because it's highly unlikely that two constitutions would be published in 20 days (12-12-63(independence) to 12-31-63(last day of year)); and (2) the statement "Kenya is a sovereign Republic" (p.8 of your second listed document) would have been invalid prior to 12-12-64, and no amendment to that statement is given in the text.

Finally, the argument is moot regarding the validity of the BC. Even if Kenya was not a Republic when the BC was allegedly produced, some bureaucrat might have prematurely put it on his forms.
