Haditha Marine update: Lt. Col. Chessani wins another round

By Michelle Malkin  •  May 6, 2009 08:56 AM

John Murtha’s big, fat mouth is still wreaking havoc on the lives of the Haditha Marines he defamed. But the Marines keep winning in court. Yesterday’s good news from the Thomas More Law Center, which has vigorously defended the accused Marines:

A government official has informed the Thomas More Law Center that the government will not seek to appeal the recent unanimous decision by the Navy Marine Corps Court of Criminal Appeals (NMCCA) in favor of LtCol Jeffrey Chessani, USMC.

The decision makes permanent the ruling by the trial court judge, Colonel Steven A. Folsom, USMC, dismissing the charges against LtCol Chessani, without prejudice, due to Unlawful Command Influence. The government could have sought an appeal to the civilian Court of Appeals of the Armed Forces (CAAF), and then to the U.S. Supreme Court.

Gary Gross and Jim Hoft have full coverage — coverage you won’t find in the MSM outlets that trumpeted Murtha’s smears three years ago.

Unfortunately, it’s not over for Chessani just yet:

The Marine Corps may be closer to giving up its troubled prosecution of Lt. Col. Jeffrey Chessani, the highest-ranking officer accused of wrongdoing after 24 Iraqi civilians were slain in the city of Haditha in 2005.

Chessani’s attorneys said Tuesday that they’ve been told the service won’t seek a third appeal of a ruling dismissing two counts of dereliction of duty against Chessani, who is accused of not ordering a full-scale investigation into the killings.

A Marine Corps spokesman, however, said a final decision on possible further appeal hasn’t been made. But the attorney for the appeal, Navy Lt. Timothy Delgado in Washington, confirmed a recommendation to drop the matter has been issued.

If that recommendation is followed, a final decision on whether the case gets dropped rests with Marine Corps Commandant Gen. James Conway.

And if that happens, Chessani would become the seventh of eight Camp Pendleton Marines charged with crimes at Haditha to be fully exonerated.

“Our whole center is just waiting to see what the government now decides to do,” said Chessani attorney Brian Rooney of the Thomas More Law Center in Ann Arbor, Mich. “We are very hopeful that the decision is to end the case so Col. Chessani can get on with his life

The Law Center is receiving donations from patriotic Americans all across America to support the cost of their defense of LtCol Chessani.People - Savage in StudioOne of LtCol Chessani’s greatest supporters is conservative radio talk show commentator, Dr. Michael Savage.  Dr. Savage personally donated upwards of $20,000 dollars to the Law Center to assist in LtCol Chessani’s defense.  It is estimated that because of his encouragement, Savage listeners donated tens of thousands of dollars to LtCol Chessani’s defense as well.

Richard Thompson, President and Chief Counsel of the Thomas More Law Center, observed, “Michael Savage has given a national forum to the Law Center so that we could show the government’s persecution of one of our bravest combat leaders.”

So... when is Murtha going to be prosecuted for treason? Or is destroying our troop-morale and endorsing the enemy’s claims by condemning them before the allegations had even been investigated NOT treasonous?

I guess that elected officials can't be held responsible for what comes out of their mouths.

Nancy Pelosi is a case in point!

At what point, I ask, do these people who are supposed to be our leaders be held to account for their words and their actions?

More importantly, at what point are they domestic enemies of the Constitution that our armed forces are sworn to defend?

SATAN’S Protege, John Murtha, should be Frog Marched in Shackles thru PARIS ISLAND and then Thru Quantico giving each of Our Fantastic Marines 4 Minutes to personally spit on the Traitor and Scumbag Crook and explain to the Moron what they really think about his Traitorous Actions and Wild Accusations.

Does the senile lummox Murtha brag about his trips to Walter Reed anymore?

Can’t imagine he’d be welcomed there.

The Marines deserve the right to see Murtha crying, sobbing and begging for forgiveness as he is thrown into a Supermax with Khalid as his roommate and husband for the rest of their wretched lives on this Great Earth, GOD’S WONDERFUL CREATION!

Let's see now over $20,000 to Chessani, and helping solicit untold thousands more from his listeners for his defense versus $5,000 to one Jerry Brown, so where does Savage's loyalty lie my dear Savage haters?

You guys are always screaming about Savage's one time donation to Brown, why aren't you screaming about the thousands Savage has donated in defense of our persecuted military men? Of course info like that just hurts your cause doesn't it? And how much has Rush donated and publicly defended our persecuted soldiers again?

Oh my goodness WITT,, do you really expect the SAVAGE haters to admit that SAVAGE actually does good things, he talks the talk and walks the walk unlike OTHER talkshow hosts, oh no my friend, all SAVAGE does is rant and rave and donate money to Jerry Brown and SAVAGE’s son is not a republican, hate hate hate SAVAGE, the fact that he has donated large amounts of money to help solders including Chessani is beside the point and yes I too would be very very interested to know how much that blowhard golfer has donated to help Chessani, the Haditha crew et al and we know what the answer will be, the golfer doesn’t like to brag about it, LMAO, funny thing is he brags about everything in his life so I’m guessing the truth is he’s donated zip to Chessani.

Weiner also does good things when he is petting his dog Teddy (in between Teddy's beatings).
