W v F was one of the worst instances of judicial activism ever. Ranks right up there with Marshall’s dementia inspired “incorporation” farce.

I hope you're referring to Thurgood Marshall and not the great Federalist John Marshall!

Yes, John Marshall whose ability to read "all intents and purposes as part of said Constitution" and "laws of any State to the contrary notwithstanding" and still pull out some imaginary "incorporation" power kinda over turned every other good thing he'd done in his overly long career.

Barron V Baltimore came just two years before his death. Senile Dementia is about the only explanation for his over-sight of Art 6 Para 2.
