Two Pennsylvania teens were acquitted of murder, aggravated assault and ethnic intimidation charges Friday in the beating death of a Mexican immigrant last summer.
However, a Schuylkill County jury found Brandon Piekarsky and Derrick Donchak guilty of simple assault stemming from the death of Luis Ramirez, who died of blunt force injuries to the head after a fight with the defendants and their friends.
Donchak, 19, was also found guilty of providing alcohol to the group of teens that encountered Ramirez the night of July 12 on a residential street in the rural mining town of Shenandoah.
Prosecutors alleged the teens baited the undocumented Mexican immigrant into a fight with racial epithets, provoking an exchange of punches and kicks that ended with Ramirez convulsing in the street, foaming from the mouth.
He died two days later in a hospital in Danville.
Piekarsky, 17, had faced a charge of third-degree murder for allegedly delivering a fatal kick to Ramirez's head after he was knocked to the ground. He also was found not guilty of ethnic intimidation, aggravated assault and attempting to solicit a cover-up....
The incident drew national attention to the small town of Shenandoah, highlighting issues of race relations.

This is an outrageous crime; something which anyone should become upset over no matter the origin and nationality of the victim.
That being said, calling this a hate crime in order to worsen the charges is complete bull. A crime is a crime no matter the skin color of a person.

Yep. All violent crimes are crimes of hate. It's a slippery slope when we begin to adjudicate someone's emotions and not their actions. There are plenty of crimes that these punks could have been charged with besides some type of "hate" enhancer - menacing, incitement etc. etc.
Having said that, justice was not served here. No one has the right to murder - and this was murder. I'm afraid that there may have been some kind of jury nullification in this case. Some of these states have such strange laws. I'm not sure how a death can result from a "simple assault" and the person not be found guilty of at least manslaughter. Very odd.

Unfortunately, I think the reason they were acquitted of murder might have something to do with the fact that the victim is partially culpable for his demise because he responded to provocation instead of walking away. If the teens had just jumped on him and started whaling on him, the outcome of the trial might have been different...
The illegal was only taking the beating the legal citizens didn’t want.

As someone has already said, I’m sure we’ll be hearing more about this in the days ahead.
We only know what the leftist media reported as to the facts of the case. Obviously, that story was not so true or they would have been convicted of the crimes the newspapers said they committed.
Remember the Leftist newspapers jumped on this story when conservatives managed to shoot down shamnesty. This was to prove that being against illegal immiragion was “hate” and inspired “hate crimes.”
So now we know the rest of the story.
This looked pretty cut and dry to me. What we should be watching for is further defenses based on racial grounds over the actual facts.
It’s true that the influx of illegal aliens brings them into our society without knowing they can’t get away with rape, murder and such. The social disconnect between this guys culture (”old enough to bleed”) and ours led to a physical confrontation that didn’t work out for him.
I have no sympathy for the illegal, as anyone trying to make it here, especially under the wire, should know the law and remember they aren’t guests, legal immigrants or welcome at all if not labeled as refugees. Perhaps he should have sold himself as a Moslem, as they seem to be getting a lot of slack cut for barbarianism where child brides are concerned.
And you were so right. Feds just charged the teens with hate crimes and included the cops for the cover up and other corruption.
