No, our elected Republicans need to be demanding face time on TV to oppose and their reasons for opposing all the socialist crap the Dem’s are forcing upon the good American citizens. Of course they don’t stand an ice cube’s chance in he!! of things going our way, but they can’t stop working.

If Scalia, Thomas, Alito, Roberts, and Kennedy remain during Obama’s tenure, concern should be limited.

The status quo on the court is killing this country. With at least Souter and Ginsberg leaving during an Obama administration, this will continue for another generation.

I suggest everyone go to scotusblog and read Goldstein’s post titled, “Justice Souter?s Retirement and Where We Go from Here.” It’s hilarious in the sense that Tom really does try his best to make Souter sound good. In fairness, it’s a difficult task, because Souter authored few opinions that were landmark or significant . For all his supposed brilliance, he did almost nothing to influence constitutional law besides act as a vote. The three most recent justices, Breyer, Roberts, and Alito, have all contributed more to the development of law.

Thank God he’s soon to be gone.

Breyer has only contributed to the further erosion of the constitution.

I think they’d love to do the same thing with Congress and our Presidential elections; replacing state representation with representation based on race, gender, and other similar group identifications. We’re already well down this road in some ways; witness the requirement for majority black Congressional districts and the now deeply-ingrained notion that only a black Congressman can properly represent the interests of black constituents. Frankly, I think that sort of thinking also forms a substantial part of the motivation behind the “National Popular Vote” movement; if you think identity politics are big in Presidential elections now, wait until you see the effective abolition of the Electoral College.

Supreme Court Justice David Souter has announced that he will retire at the end of the Court's current term. In filling the vacancy he will leave, President Obama has the opportunity to nominate someone who is committed to core constitutional values: justice, equality and opportunity for all… someone who is faithful to the Constitution, its values, its principles and its history. That means WE must be diligent. The progressive agenda for the term of this administration and the next several decades depends on having a Supreme Court that will not block progress. The Right Wing knows this and will do all it can to prevent change on the Court.

Do you remember William Buckley's argument for putting Biden on the USSC after the Neil Kinnock plagiarism incident in 1988? He said put Biden on the bench and then give him copies of Robert Bork's opinions. Might still work.
