We can always hope for another Justice White. I’m sure Obama will pick someone who’s a member of the ACS though.

If he’s smart, he’ll pick someone with the views of Brennan, the stealthiness of Souter, and the calmness of Roberts. If he picks a firebreather, that could cause the libs serious problems when trying to win over Kennedy. Breyer would have to work even harder on that than he does now, Iol. I doubt Obama wants that.

Aye. This is the real penalty. McCain may be a RINO, but at least if he had won we wouldn’t be facing pure socialist SCOTUS members.

I tend to be an optomist. I don’t think we can get anyone much more liberal than Souter wound up being. In the history of the supreme court many appointments have been rather surprising - many republican appointees became much more liberal. Historically there have been some liberals that became more moderate - so I would have to say that it is time for a Dem pick to wind up being the equivalent of Republican Souter or Kennedy pick - a liberal that moves center-right. There is a chance, especially since justices in general see themselves as a counter balance to the executive and legislative branches - which have obviously tilted heavily left. Keep the faith and keep fighting.

Souter was a moderate when GHW Bush nominated him but turned into a liberal along the way. Happily for us, GHWB also nominated Thomas who cancels Souter out. Clinton got in two liberals which bumped the court leftward. Reagan put in one conservative, Scalia and two swing voters, Kennedy and O’Connor.

Unhappily for us, older conservatives can degenerate into swing voters, but older liberals never improve.

I don’t think there are any qualifications, per se, for Supreme Court Justice. He could appoint his cousin Odinga if he wanted to.

How much worse can you get? Raging lib direct replacement is all it will be.
