TMLC: A Victory for Marine LtCol Chessani
Thomas More Law Center ^ | March 17, 2009 | (no annotation)

Chessani Case - Chessani Head Shot - FinalANN ARBOR, MI – Late this morning, the Navy-Marine Corps Court of Criminal Appeals sitting in Washington DC, released their unanimous decision upholding the dismissal of charges against Marine Lt. Col Jeffrey Chessani on the grounds of apparent Unlawful Command Influence.  But the case may not be over yet.

For the last four years, LtCol Chessani has been investigated and prosecuted for his involvement in the so called “Haditha Massacre” – a massacre that never happened.  A 22-year veteran, Chessani has served three tours of duty in Iraq.  He served in the First Persian Gulf War and in Panama.  At the time of the November 19, 2005 Haditha incident, he was the Battalion Commander of 3rd Battalion, 1st Marines (“The Thundering Third”) – one of the most decorated units in the history of the Marine Corps.

Richard Thompson, President and Chief Counsel of the Thomas More Law Center, observed, “LtCol Chessani, one of the most effective combat commanders we had in Iraq, was a made political scapegoat by the civilians in the Pentagon to appease the antiwar politicians and a liberal media.  In fact, we now know that the story of the ‘massacre’ that prompted the Haditha prosecutions was a headline in a Time news article instigated by insurgent propaganda operatives.”

LOL, Red. No green beer, corn beef or cabbage....just gruel.

Hopefully the prosecution decides to call it a day after all is said and done. They may want to continue fighting Chessani’s UCI dismissal because of the implications it may have for SSGT Wuterich’s case.

Yeah, it sucks. It’s my opinion that Walker omits the vital factor of immediacy during the response to the attack, and his characterization can give the impression of planned retaliation against the innocent victims. This is the impression I got from an earlier article.

Speaking of Murtha and CBS, CBS (now that the election is over) had a story tonight ripping Murtha on earmarks, could be big legal trouble...

ROFLOL! Murtha waving that little red copy of the Constitution around is a great impersonation of Robert Byrd!

It's been his m.o. all along.

That’s an excellent description, I knew he reminded me of someone doing that and it was Byrd. LOL!

Murtha’s about 15 or 20 years younger but about as far gone.

I agree with your assessment, 4wb. I don't believe Col. Ewers interrogated SSGT Wuterich, but he was involved in writing up the investigation findings for the Bargewell report, hanging out with Gen. Mattis and the other SJA's, yada, yada, yada. Read this letter, An open letter regarding Haditha to General Peter W. Chiarelli, for an interesting perspective on the Watt/Bargewell reports.

Ewer's statements on TV, in the Frontline documentary, Rules of Engagement, :

"I think that our Marines were appropriately trained for the mission that we were trying to accomplish. The idea that because we're a blunt force instrument that we're not-we're ill-prepared to do that is a cop-out. The point is, is that we're Marines. We're the-we're the toughest guys on the block. We know how to defend ourselves. We know how to-we know how to aggressively take people down. And to suggest that we can't do the shades of gray in between is a cop-out, and I think it sells Marines short."

He dared to be called out for UCI with his fingers (inappropiately) in every piece of the whole Haditha case....and he got busted for it.

I’m so glad this guy went free. He is a hero, and a good officer. He doesnt deserve to be painted as the bad guy. It figures that the liberal media would take a bunch of heros and crucify them.

The two of them on tape with their mini Constitutions would be like a decrepit Abbott and Costello routine. :)

Wow! The Feds are closing in on Murtha. From your link, jaz, Questions About Murtha Contract Awards :

"CBS News has learned that federal agents are also looking into a Murtha-backed research firm "Electro Optic Center." According to a source interviewed by the FBI: In one year, the Center sought $120 million in earmarks directly through Murtha's office and managers urged employees to donate to Murtha so the Center would get favorable treatment.

We found at least six donors linked to the Center gave to Murtha on the same day last year, just days before earmarks were decided.

Republican Rep. Jeff Flake, who's against earmarks of any kind, is calling for an ethics investigation and says it could dwarf the last lobby mess to hit Washington.

"In terms of contributions and circular fundraising and the involvement of members it's much bigger [than the Abramoff scandal]," he said. "Much bigger."

What a great day! Sec. Navy Winters is out, Murtha is being hammered for his earmark ethics, and Lt. Col. Chessani has the UCI dismissal upheld.

You’re right, Girl, it is a great day.

That piece by CBS was totally unexpected by me. The wife was watching that news which I never do and I heard his name mentioned and went in to see it. Was really surprised that a member of the MSM would air that.

The investigation of those companies is being done by the FBI, DOD and IRS and those companies surround Murtha, he’s been connected to all of them heavily and I believe had a hand in starting some of them.

Even though Murtha says they haven’t contacted him as yet I’d bet a lot he’s darned worried, it’s only a matter of time until he is contacted and when is hopefully he will be led away in handcuffs. :)

What I find really interesting is the fact that it's CBS hammering Murtha. Yesterday or the day before Daily Kos, the far left nut website, and the Washington Post went after Murtha too!

Daily Kos, CBS,the Post and the Democrat Party are virtually one and the same.

I fully expect the New York Times to jump in as well.

A decision has apparently been made in the Leftist fever swamp braintrust, perhaps by the slimy Soros himself, that Murtha is expendable.

I think we're in for some interesting and entertaining days ahead! WOOHOO!!!!!

Hmmm....Murtha Gate part (lost count) and Obama funny money accounting (can't count that high) on the same night on CBS?

Has the world turned upside down or is there blood in the water and the thrashing is just too irresistible?

Thanks Girlene, it was a little rough, but you know how to read my writing ;~)

Thanks for the links, will read 'em 1st thing in the morning. I remember the Ewers quote, but hadn't seen the letter or the rest of the military experts like Babyface Josh White all chime in one place.

I have a large walnut slab that I'm making into a desk that needs a tremendous abount of sanding - I'll check out the Frontline trash right before I head out to the shop in the morning.
