Didn’t President Bush just pass this executive order a couple of months ago? How does that qualify as always? How did these hospitals operate in the years before this EO was put into place? Why did President Bush wait until the end of his term to do this if it is so essential to the operation of Catholic hospitals?

Legal challenges to opting out are recent. The Exec order wasn't needed, 'til the forces of death were empowered by election results.
