WASHINGTON, D.C. On Wednesday, Nov. 19, U.S. Supreme Court Justice Clarence Thomas distributed Leo C. Denofrios renewed application for a stay of the election for conference on Dec. 5.
His first application was denied by Justice David Souter on Nov. 6. However, rules of the court allow for the renewed submission to a justice of choice.
Beginning in October, Denofrio made his way up through the ranks of the courts until his constitutional question as to the meaning of natural born citizen reached the Supreme Court.
He submitted an application for an emergency stay to prohibit the use of what he called defective ballots in the state of New Jersey because they contained ineligible candidates for the office of President of the United States, and asked that the court order New Jersey Secretary of State (SOS) Nina Mitchell Wells to remove the names of Republican candidate John McCain, Democratic candidate Barack Obama and Socialist Workers Party candidate Roger Calero from New Jersey ballots.
According to Denofrio, the three candidates are not natural born citizens, as required by the Constitution to hold the office of President of the United States...
New Jersey statute requires Wells to make astatement wherein she certifies, under her hand and official seal of office, the names
of all such candidates for whom the voters within such county may be by law entitled to vote at such election....
If the SOS doesnt protect the citizens of New Jersey, Denofrio states it is then up to the citizens to command Wells to do so.
As a result of Wells misfeasance, Denofrio says the states ballots contain the names of three presidential candidates who are not, by law entitled, to hold the office of President of the United States.

Judge Jack M. Sabatino Named to Appellate Division
Superior Court Judge Jack M. Sabatino has been named to the Appellate Division effective Mar. 1, today announced Chief Justice Deborah T. Poritz.
“Judge Sabatino possesses not only great intellect but also a passion for the law that distinguishes him among his peers,” said Chief Justice Poritz. “I am confident that he will be an asset to the Appellate Division.”
Judge Sabatino holds a B.A., summa cum laude, from Yale University and a J.D., cum laude, from Harvard Law School. He served as a judicial law clerk to the Hon. H. Curtis Meanor of the United States District Court for the District of New Jersey and thereafter as the first law clerk of the Hon. Marie L. Garibaldi, associate justice of the Supreme Court of New Jersey.
Judge Sabatino worked in private practice until 1989, when he became the State’s assistant attorney general in charge of civil litigation. He then served as the director of the Division of Law before joining the faculty at Seton Hall Law School and, later, Rutgers Law School-Camden. He was nominated to the bench in 2001 by Gov. Christine Todd Whitman. First assigned to the Civil Division of Mercer County Superior Court, Judge Sabatino currently sits in the Family Part in that vicinage.
Judge Sabatino has served on the Supreme Court Civil Practice Committee as well as several other court committees. The judge continues to volunteer his time as an adjunct instructor at Rutgers-Camden, teaching evidence law and other subjects.
The Appellate Division of Superior Court is the state’s intermediate appellate court. Appellate Division judges are named by the chief justice from among the judges of the Superior Court. The 35 appellate judges are assigned to one of eight parts; each case is heard by a two- or three-judge panel formed by members of one part.
“I am truly grateful for the confidence that the Chief Justice has reposed in me. I look forward to continuing to serve New Jersey’s citizens in this new role with another fine group of dedicated judicial colleagues,” said Judge Sabatino.
A Pennington resident, Judge Sabatino has two children, PJ and Julia.

Wasn’t going to do anymore interviews, but Leo called the New Jersey appellate division to check what was on file.
Official allegations filed by Leo today to the New Jersey Supreme Court against Judge Sabatino that he improperly tried to get Leo to file an “improper” lawsuit to deliberately trip up Leo.

Unbelievable. Leo is a true hero. He’s got great instincts.
