Well, if it’s kicked under the rug—your words—then this will mean that the Supreme Court has abdicated, and we will have no laws protecting the nation and its people. That’s the way I see it.

Yep. That's an accurate statement and I agree with you on it. Doesn't mean that I like it, though. I'm just trying to be pragmatic.

I think that the current SCOTUS won't be willing to trade social unrest for upholding the Constitution. 'Tis what you get when current politics demand spine removal. At worst - for all sides, and for all outcomes, and the most likely path IMHO, they duck and refuse to hear the case at all. At best, they figure out some way of upholding the law, while avoiding the social upheaval that will happen when they do it. I put the likelihood of this happening as "Extremely Low".....but, the SCOTUS might be a lot smarter than I (and other FReepers) am.
