Yep. That's an accurate statement and I agree with you on it. Doesn't mean that I like it, though. I'm just trying to be pragmatic.
I think that the current SCOTUS won't be willing to trade social unrest for upholding the Constitution. 'Tis what you get when current politics demand spine removal. At worst - for all sides, and for all outcomes, and the most likely path IMHO, they duck and refuse to hear the case at all. At best, they figure out some way of upholding the law, while avoiding the social upheaval that will happen when they do it. I put the likelihood of this happening as "Extremely Low".....but, the SCOTUS might be a lot smarter than I (and other FReepers) am.
I’m afraid you are right—the terrific upheaval resulting from the lawful decision may scare them away from upholding the Law and they can refuse to hear the case. this is scary as hell.
Okay so SCOTUS won’t rule to have the country descend into anarchy. Will the State of Hawaii refuse to relase the original long form 1961 birth certificate when it is requested for the formation of the Presidential Library? IMO the Department of Health in Hawaii is simply delaying the inevitable with their refusal to release the document! What will the citizens of the United States say at that time if the long form birth certificate reveals that Jr was in actual fact not born in the United States, especially if he is sworn in as the 44th President and has a disastorous administration? How angry do you think citizens will be then? Just think of the Constitutional Crisis which would occur then!
