A former Border Patrol agent's lengthy sentence for shooting a fleeing drug smuggler had been described as extreme by his supporters, but a federal judge showed no mercy Wednesday at the former agent's resentencing hearing in El Paso, Texas.
The judge upheld Jose Alonso Compean's original punishment and resentenced him to 10 years in prison for his conviction on a charge of using a weapon in the commission of a felony and another two years in prison for assault and other charges, the U.S. Attorney's Office said.
Compean's attorneys plan to turn to the Supreme Court for a review of the case. Bob Baskett, an attorney for Compean, did not immediately return a call for comment from FOXNews.com.
Compean, along with former agent Ignacio Ramos, was convicted in 2006 of shooting Osvaldo Adlrete Davila an admitted, and now convicted, drug smuggler and trying to cover up the shooting.

You are too kind.
Highly unlikely. But don't be surprised if he pardons more than a few real criminals.
Yes the media fawned all over McCain in the primaries with as much energy as they demonized Palin. It should be obvious that the media spews its venom at those they fear the most. The media spewed their venom at Romney. The anti Mormon conservatives obliged the Media and killed the best chances they had of stopping Obama.
Prayers for these border agents~~~email to Pres. Bush to pardon them!
Amen to that.
About 15 years ago a friend of mine was fishing on the All American Canal with his family. Some illegals on the south side of the canal were taunting him and his family. When one of them ran across the check, he grabbed a Border Patrol service shotgun from the trunk of his car and shot that idiot in the ass. He had to pay a judgement and that was it. The Border Patrol sure has changed.
They did not file a false report and they did not destroy evidence. These myth just won’t die.
myth=myths
Not to worry; President Barabbas will soon start CPR, and pump'er dry.
Fortunately he will keep that title. He almost had a challenger with McCain.
Might not have taken so long, had 9/11 not interferred.
When pigs fly...
Sure, it would cost nothing to ask 0bama to pardon these Border Patrol agents and it would be a coup for 0bama to grant the pardons. He could demonstrate in deed as well as word that he does intend to correct mistakes of the Bush administration.
Might not President Bush go ahead and grant pardons now if he thought a President 0bama was going to do it?

It got so bad, even CBS had to notice!
Honest!! Tonight, CBS News, Katie Couric, even. At the end of the broadcast, they warned that sooner or later someone innocent will get killed.....
HELLO!
They still dont get it.....but they finally reported it. Oh, well, lets call it progress anyway.
Poor Media....youd think theyd get tired of always being the last to know!

This is an outrage. 200 years ago the accused would be freed and the judge would be facing seriouos problems.
The courts no longer serve America or the people. They have become self-sustaining independent organisms which reflecct the personal whims for the judges.
Thank you. Lou Dobbs covered this gross miscarriage of justice on his Wednesday night program with good analysis and courthouse video. Will post video and transcript when it becomes available.

Kathleen Cardone's career took a sharp turn in 2003 when the U.S. Senate confirmed her nomination (nominated by Bush) as a federal judge in the Western District of Texas. In nearly 25 years as an attorney and judge, she had devoted much of her time to family law and worked to improve the family court system in El Paso. She had also volunteered with many family-focused community organizations, such as the Children Cope with Divorce Program and the Domestic Violence Task Force Commission.
But as the first female federal judge in El Paso, "I've stepped away from all that totally," Cardone said. Instead, she presides over cases that touch on other important social issues, such as employer-employee relations, education and immigration -- an especially pressing matter in a border town. "The kinds of cases we handle have such an effect on everyday society that it's very fascinating, interesting work," she said.
You might say Cardone was destined for the law. Her father is an attorney, and four of her five siblings also attended law school. At Binghamton, she double-majored in Spanish language and literature and Latin American studies. She chose a law school in San Antonio in part because she wanted to be near the Mexican border, where she could use her linguistic and cultural knowledge and perhaps practice international law.
Another Bush appointee who is completely enamored of the 'hispanic culture'.
United States District Court Judge Kathleen Cordone (see Post 34 and Post 58).
Outrageous. I did not see the name of this judge listed in the article. One can only wonder about this judge’s agenda.
