(Lafayette Hill, Pennsylvania – 10/25/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that he is immediately appealing the dismissal of his case to the United States Supreme Court. The case is Berg v. Obama, No. 08-cv-04083.
Berg said, "I am totally disappointed by Judge Surrick's decision and, for all citizens of the United States, I am immediately appealing to the U.S. Supreme Court.
This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?
So, anyone can just claim to be eligible for congress or the presidency without having their legal status, age or citizenship questioned.
According to Judge Surrick, we the people have no right to police the eligibility requirements under the U.S. Constitution.

We must legally prevent Obama, the unqualified candidate, from taking the Office of the Presidency of the United States,” Berg said.

There were several suits challenging Goldwater's natural-born status. Were they all thrown out for lack of standing? As I remember it, the California case filed by Melvin Belli might have been, but the New Jersey case was decided on its merit was it not?

So, you think that the GOP knows that Obama is not eligible, but is willing to see him elected and are willing to sacrifice races all over the country?
For what? If they started airing wall to wall commercials with concrete proof, they would force the hands of election boards nationwide. The election would be over, McCain would win, and the GOP could spend it's money and momentum on all the other races.
The people who are voting now have long ago made up their minds. Those are NOT the people who are going to have their minds changed even if Obama suddenly sprouts horns and a tail. The People who matter are the ones that will not make a choice until just before the election. The swing voters. I am certain that both campaigns are taking that simple fact into account.
The State Department would know and would have known long ago if Obama's birth certificate was real or not. Why has no one acted if they know? Those people hadn't voted when Obama was vetted for the committees he sits on, or when he got his passport.
I ask this seriously:
Why you are supporting the GOP or it's candidates if they are willing to sell the nation down the river and potentially allow Obama to be elected and hundreds of Democrats nationwide?
and/or:
Why are you supporting the GOP or it's candidates if they are unwilling to even demand an investigation? McCain himself is on record as saying: "No, ma'am, he's a decent family man, a citizen, who I just happen to have disagreements with on fundamental issues."

The Constitution of the United States that I am looking at right now states:
“We the People of the United States, in Order to form a more perfect Union,...Do ordain and establish this Constitution for the United States of America.”
The constitution sets forth the eligibility requirements, so in my view, every elected official or those persons that strive to be elected by the people are answerable to the people, therefore any citizen of the United States has a right to bring a question to the court.
But I’m not a judge, I just read my Constitution.
Maybe we should send some Constitutions to the Judiciary.
Question: What are the requirements to become President?
Answer: The United States Constitution outlines the requirements for President in Article 2. This article of the U.S. Constitution also outlines the many powers of the President and Executive branch of government.
Section 1 of Article 2 of the U.S. Constitution states that a President must:
* be a natural born citizen of the united States
* be at least 35 years old
* have lived in the U.S. for at least 14 years
In addition, the 22nd Amendment to the U.S. Constitution states that a President may not serve more than 2 terms of 4 years each, even if they have only served as President for 2 or more years of one of those terms.
Every President in our Nation's history has qualified based on these requirements. Barack Obama aka Barry Soetoro needs to provide evidence that he is eligible to be run for the office of President.
What is weird about Obama and Axelrod is that this situation shows how little respect they have for our history. It's as if they are saying to the Founders of our nation,"Yo, Washington and Jefferson...‘Whatever’." Obama is probably qualified, but the fact that he would allow this to be an issue this late in the election is beyond anything any other Presidential Candidate has allowed. Obama is a thug and a deceiver. Unfortunat and quite frankly very weird..
