You're joking, right? What do you think a Democrat Congress, its numbers swollen after the election, are going to tell you? To shove it! The rule of law died in this country.

The desperate attempt of democrats and their media to avoid talking about it seems to indicate that it worries them.

And why do you think every liberal whack job environmental group has standing to sue over nothing?

Rule of law in America is in serious trouble. The Second Amendment is your mine canary.

This judge was certainly trying to pass the buck. He was wiggling out of having to make a decision while running out the clock. Typical of the legal system.

If, through the political process, Congress determines that citizens, voters, or party members should police the Constitution’s eligibility requirements for the Presidency, then it is free to pass laws conferring standing on individuals like Plaintiff. Until that time, voters do not have standing to bring the sort of challenge that Plaintiff attempts to bring in the Amended Complaint.

Does this mean that people cannot make a "citizen's arrest?"

Just who, if anyone, in today's government has "standing?" Why are they NOT standing? Being eligible to run for the Presidency of the United States is fundamental to our Constitution. What body or persons are responsible for vetting the basic requirements of the Constitution?

We are having right now a Constitutional Crisis, and no one seems to care in our government. What is going on? Are we already "cowed" by the Marxists?

I believe that Barclay Surrick is dead wrong. But so is the DNC for not properly vetting the Obamessiah and the states for allowing him on their ballots, especially if there are questions about his eligibility.

In the event that he gets elected and is found later to not be eligible, America will have a genuine Constitutional crisis on its hands.

Also, since neither the Bush Administration nor the Congress will perform their sworn duties to protect this country and defend, protect and uphold the Constitution, the citizens will have to - especially if the states won’t!

Someone posted in another thread that this should be presented to the electoral college. Makes sense to me, but in the meantime, this needs action and widespread media.

Now is the time for a prominent, credible media person to champion this issue. Do it loud and do it until there is a resolution(produced authentic BC).

At this point Berg looks like an amateur. Standing is interesting. Obama gave the Court jurisdiction when he responded to the initial filing. IF it is true that Obama did not respond to the discovery then it should of been a slam dunk summary judgment. Looks like a Court punt and score for the bad guys unless Berg is working some angle I haven't thought of. This was always a cr$p shoot.

This is sad, when Berg on the Savage program the other night said that the judge was a Clinton appointee but was a Republican.

Rinos abound.

Just whose freaking Constitution is it anyway, if not the People’s? If only Congress has standing, then our freedom is already lost. Which State AG has the cojones to bring suit?

"So, who does have standing? According to the Hon. R. Barclay Surrick, that's completely up to Congress to decide."

So what stops Bill Clinton from running for a third term?---Since the Legislature now interprets the Constitution?

As concerned as I am that America, the PLACE, is in danger, I am far more concerned that America, the IDEA, is on the verge of being devastated in ways the Founders could never have imagined.

My great-great grandfather fought with the 80th Ohio Volunteer Infantry at Chickamauga, Vicksburg and marched to the sea with Sherman. My wife’s great-great grandfather also fought on the Union side. Given the quasi-tyrannical nature of the current central government, we’re both sad that they fought in a struggle to secure Washington’s grip on the states in violation of the VOLUNTARY compact between those states to create that central government in the first instance, the Declaration of Independence.

Now that central government — and the power it has usurped from the states and the people — may be about to fall into the hands of a group of men and women who care even less for those principles than Mr. Lincoln did when he launched one of the deadliest wars in history.

I admit to having many problems with Mr. Lincoln. Forensic historians now view him to have been more motivated by his own internal demons and depression than by a desire to keep together by force a union some voluntary members of which chose to “...alter and to abolish..., and to institute (a) new Government...”

Inasmuch as history is always written by the victor, I recognize this will be totally foreign to those who have not spent time examining that history in detail. But I said all that to lay the basis for this, one of the few things on which a younger, pre-presidency Lincoln and I might agree:

“At what point shall we expect the approach of danger? By what means shall we fortify against it? Shall we expect some transatlantic giant to step the ocean and crush us at one blow Never! All the armies of Europe, Asia and Africa combined with all the treasure of the earth (our own excepted) in their military chest, with a Bonaparte for a commander, could not take a drink from the Ohio or make a track on the Blue Ridge in a trial of a thousand years.
“At what point, then, is the approach of danger to be expected? I answer, if it ever reach us it must spring up amongst us; it cannot come from abroad. If destruction be our lot we must ourselves be its author and finisher. As a nation of freemen, we must live through all time, or die by suicide.”
Abraham Lincoln, 1837

America, the IDEA, may soon suffer a blow which will render it a small footnote in world history. Given that history IS written by the victors, it might not even be mentioned at all.

I tremble for our grandchildren.

“To reiterate: a candidate’s ineligibility under the Natural Born Citizen Clause does not result in an injury in fact to voters.” Judge Surick

I feel very injured, Judge.

Many around here get upset when judges act in a manner that they disagree with. In this case a Judge said basically that it is not an issues for the Court's to decide. It is up to the people and now many of the same a pissed off? Please.

Berg will appeal! This piece was just posted at America’s Right- I haven’t had time to read it yet.

As I said before- I’ve had a very difficult time taking Berg seriously because of his 9-11 truther background.

I DO however, believe that Obama is lying about his birth- and am alarmed that none of the cases seeking him to prove himself seem to be bearing fruit.

Off to read the piece now :)

It seems to me that prior to the election the only person with standing is Hillary Clinton.

Comments from Jeff Schreiber-this is why we need to call on Congress!

Call on Congress?

The answer is to nominate a Presidential candidate who talks about conservative issues unashamedly and does it with a smile and some humor....and then follows through.

If the press had raked Reagan about the cost of his wardrobe he wouldn't spend time defending it....he would pop their balloon with "Well, you sure wouldn't want to see me naked." or something and that would be the end of it and the people would love him for it.

If you say read my lips, keep the promise. If you establish a "Contract with America", follow that contract to the letter.

None of the gimmicks work very well. Lawsuits, impeachments, nude pictures of momma, turban pictures. You can't win an election solely attacking your opponent.

Go back to what works. Reagan is a good model.
