FEC joins call to throw out suit against Obama (Berg's challenge of BHO's citizenship)

The Federal Election Commission has joined Barack Obama and the Democratic National Committee in asking a federal judge to dismiss a lawsuit filed by a Montgomery County attorney seeking Obama's ouster from the November ballot.

Philip Berg, who claims the Illinois senator was born in Kenya and can't run for president because he isn't a natural-born U.S. citizen, has no standing to make the claim, according to the FEC.

The motion, filed Tuesday in U.S. District Court in Philadelphia, echoes one filed last month by Obama and the DNC that states Berg hasn't demonstrated how he personally would suffer even if his ''ridiculous and patently false'' claims were true.

So... I guess this means that you could be a Moslem, highly-placed al-Qaeda operative with Bulgarian citizenship and links to Russian and Chinese intelligence, born in Mozambique and educated in Venezuela, with a wife and kids in Malaysia and draw a salary from the Syrian military, and no one wants to know about it - provided only that you can get the American MSM and enough moronic, would-be voters behind you. Personally, I find the whole thing a little surprising.

On this issue “Rules of Civil Procedure” be dammed. Have him produce the Birth Certificate and get it over with. Forget the “Procedures” and prove to the American people, of which 50% want to know, that he is a citizen. Seems that democrats really don’t care. If they don’t care then anyone in the world can be our President. How about Chaves, or Castro?

How has this issue been allowed to slip under the radar for so long? If Obama wins the election, will it even be valid if he was born in Kenya? Or will that be when we are told it's time to ignore the rules of the constitution? Then the Fairness Doctrine goes into effect and we are now ruled by our new dictator.

I saw no assurances by the FEC either. Factcheck.org was run by the Annenburg Project, if I’m not mistaken — fox guarding henhouse. Did the FEC rely on that? Furthermore, a fraudulent birth certificate is a felony.

Lame and obstructing truth — only fans the fire.

Actually that is not true. Berg is a contributor to the Democrat party. His claim is he has donated money and time to the Party and THAT gives him standing. If Obama is not eligible to elected POTUS, it is up to the party to field a viable candidate. The party solicited financial donations for the election of Barack. He contributed. If Barack is not elibible, Berg is out the money that COULD have gone to a viable candidate (Hillary) At face value, the Judge is taking too long. If this were a frivolous suit as the DNC calims, it would have been dismissed long ago. This just might have some legs.

::::sigh:::: This is never going to go anywhere. Even if Obama were born outside the U.S., that does not mean he isn't a citizen. And the BS about his mom only being 18 when she gave birth to him so she does not meet some criteria about living in the U.S. for a certain period of time is stupid as well.

This guy is only succeeding in looking like a lunatic.

That tells me the FEC would be humiliated if it was found out they had allowed a candidate to get this far who wasn’t vetted properly (i.e. in relationship to citizenship.)

Exactly. The cover-up is breathtaking but absolutely understandable. The honor system for establishing natural-born citizenship has become second-nature. Now, for the first time, a serious candidate arises for whom there is reasonable doubt. And none of those responsible were doing their job and seeking proof.

Not that I agree at all with the FEC, but standing is quite an important element of a lawsuit, according to the Rules of Civil Procedure.

So who WOULD have standing for a complaint like this? It seems like the Constitution itself will bear the greatest injury, but lately the Constitution has been having trouble finding a good attorney.

There are a LOT of potential problems for the democrats if Zero is found to be running illegally. The parties are supposed to vett their candidates and at this point they would have to know. If they’re pushing a fraudulent candidate, a lot of big democrat names will go down with him.

Rush DID sort of hint to this yesterday. He said (paraphrasing) “Obama is in Hawaii to visit his sick grandmother or for some other reason.”

I don't have any legal or constitutional training but it seems to me that by this 'logic' no one would have a right to ask for evidence of citizenship in this particular situation, so wouldn't that render useless the relevant constitutional provision?

Please tell me you are not that stupid.

Or maybe you are. Do you imagine that all "citizens" are eligible to become President? If you think that, then you need to actually READ that durned old Constitution you've heard so much about. You'll find out that you must be a "natural born citizen" which means that you have to meet certain standards of birth and parentage. It is NOT automatic, and being born outside the United States certainly does complicate things, especially of one of the parents is not a citizen, and the other did not complete residency requirements.

There are three Constitutional requirements for eligibility to become President, and a President must meet all three. It's not good enough to meet two of them and expect a pass on the third. even if that would pass muster with your individual. personal standards. Thank God.
