If 8 passes, it won’t matter. The opposition will just judge-shop and have it overturned. Arnold and Jerry are in full accord with the homosexual agenda, so there won’t be an appeal. This is exactly what happened when definition of marriage passed by 2/3 majority a few years back.

Except this is a constitutional amendment, which Prop 22 wasn’t. I don’t think the state supreme court can overturn the state’s constitution.

A constitutional amendment CANNOT be overturned. All Prop. 8 would do is just overrule the California Supreme Court's May decision to impose same sex marriage upon California despite what the people wanted. Since a state's constitution is the supreme law of the state, the courts and the legislative and executive branches are bound by it. Its sad we have to amend the state constitution to protect marriage but the judicial activist liberals on the California Supreme Court has left the people with no other choice.
