Not quite....

1).. Todd is on his Alaskan Crab fishing boat....will gone for a month....would you like to hire a helicopter to fly out in the Bearing Sea to deliver the subpoena?

2).Sorry Todd has left for the Alaskan Dog Sled race....he will be back in a couple of weeks....would you like to hire a bush pilot to take you out in the wilderness to deliver the papers?

3)....So Sorry.....Todd is on his annual pilgrimage to meet with village elders of his Eskimo tribe....somewhere up in the Arctic Circle.....he may also be on a ceremonial whale hunt...expected back in a couple of months or three....

Spouses can't be compelled to testify against each other. They may be able to ask him what he did ("Nothing"), but I doubt they can ask him anything about her.
