My understanding is his mother was a US citizen, and that it doesn’t matter how long you are in the US if you are a US citizen. She could have just gotten back from a vacation to Moscow for all it mattered. I also recall that someone here on FR found his birth announcement in a Hawaiian newspaper, so I’m afraid all this B.C. fraud hype is much ado about nothing.

Your understanding is wrong. And enough has been written on this subject on Free Republic over the last three weeks that it is inexcusable for you to post something like this without having looked at the prior commentary.

8 USCA Sec. 1401(g) provides that a person, who is born outside the US to a parent who is a U S Citizen, married to a parent who is an alien (not a US Citizen); becomes a U S Citizen only if his U S Citizen parent has resided in the U S for ten years prior to his birth of which five of such years were after the age of 16.

Obama, if born in Kenya, flunks because his mother was only 18 when he was born and thus could not by definition have met the five year test.

The statute was amended in November, 1986 to provide that for persons born after November 14, 1986, the five year period becomes two years however since Obama was born in August of 1961, he does not qualify under the amendment either.

Bottom line is if he was born in Kenya, he is neither a U S Citizen nor eligible to hold the office of President of the United States.

Again, if born in the US - non issue as he would be a citizen.

If born abroad, certain technical issues come into play. Since his father was NOT a US citizen, the status of his mother comes into play and since only one parent was a US citizen, that parent must have resided in the US as an adult for 5 years PRIOR to the birth of the child for the citizenship to automatically be granted.

Personally, I'm of the opinion that someone should file in federal court a petition to prevent their state from listing Obama as his citizenship is in question. The court can then appoint a special master to review Obama’s records and report to the court on a check list for citizenship. This would once and for all decide the issue and move us past this point.
