STATE OF OKLAHOMA

2nd Session of the 51st Legislature (2008)

HOUSE JOINT

RESOLUTION 1089 By: Key

AS INTRODUCED

A Joint Resolution claiming sovereignty under the Tenth Amendment to the Constitution of the United States over certain powers; serving notice to the federal government to cease and desist certain mandates; and directing distribution.

WHEREAS, the Tenth Amendment to the Constitution of the United States reads as follows:

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."; and

WHEREAS, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and

WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

WHEREAS, today, in 2008, the states are demonstrably treated as agents of the federal government; and

WHEREAS, many federal mandates are directly in violation of the Tenth Amendment to the Constitution of the United States; and

WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and

WHEREAS, a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States.

NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE 2ND SESSION OF THE 51ST OKLAHOMA LEGISLATURE:

THAT the State of Oklahoma hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States. THAT this serve as Notice and Demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers.

THAT a copy of this resolution be distributed to the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, the Speaker

of the House and the President of the Senate of each state's legislature of the United States of America, and each member of the Oklahoma Congressional Delegation.

SPP, NAFTA Super Highway, NAU are the ones that come to mind with me. I can visualize how they might just affect Oklahoma enough to make them say, “NO!”

Who knows maybe they are just realizing what Agenda 21 is all about?

About your reference to blue helmets--I expect you're right about that, but IMO plans have been made for other forces as well.

Remember June 6, 2007 the S.Amdt. 1184 to S.Amdt. 1150 to S. 1348 (Comprehensive Immigration Reform Act of 2007) which is listed on the senate's own web site as "To establish a permanent bar for gang members, terrorists, and other criminals". It was defeated 51--46 including 10 Republican senators.

I've never figured our fine men and women in the military (post Clinton infiltrators) would fire on us for not giving up our guns or some other similar unconstitutional order, but I bet MS-13 would if they were being paid for it.

For the record, the 10 "Republicans" who voted to accept gang members, terrorists, and other criminals are: Craig, Domenici, Graham, Hagel, Kyl, Lugar, Martinez, McCain, Specter, and crybaby Voinovich.

At the time I was flabbergasted--why would any responsible person WANT gang members, terrorists, and other criminals brought in and eligible for citizenship. Then I figured it was in case law-abiding American citizens had some reason(s) to pose a problem for them...

This is one of those things that is so far down on my worry wart list that I keep forgetting about it. Primarily because it you get too far away from the line between constitutional and unconstitutional, that’s what will make old Vets across the country reach for their hunting rifles without even thinking about it.

I have no solid idea how many .50BMG caliber rifles there are in my County but I would have to say at least 100.
Anybody foolish enough to attempt to go against them guys and gals would be obliterated in seconds. Spending a morning down at the local range when they are shooting is enough to get any patriots heart beating stronger.

You misunderstand, the taxpayer still pays. The state just doesn’t send it to Washington DC, they keep it. Therefore they do not have to wait for money from DC.

Pretty sure that the #ds in its Status, the 'd' = dormant; indicates that it's effectively dead, and will not be reported out of the Rules Committee. (# = Amended by House; s = Committee Substitute.) I'm not in OK, so I can't be sure, but both NY and PA have similar actions that kill legislation.

Someone should keep a copy of it, so it can get thrown back in their faces when the balloon goes up -- they could have at least tried to stop the disintegration of our society. :^)
