US court overturns death sentence

Abu-Jamal has been on death row for 25 years A US federal appeals court has overturned the death sentence imposed on former Black Panthers member Mumia Abu-Jamal. The court said Abu-Jamal's conviction for murdering a Philadelphia police officer should stand, but that he should have a new sentencing hearing.

The former radio journalist and activist was sentenced to death for the murder in 1982.

While in jail he became a leading campaigner against the death penalty.

He appealed against the sentence, on the grounds that racism on the part of the judge and the prosecutors had corrupted his conviction, which was by a jury of 10 white and two black people.

Mumia hasn’t been on death row for years. His sentence was commuted to life. No?

When a man who is so obviously guilty games the system for decades it leads to an increasing contempt for the rule of law; and contributes like nothing else to the lure of ignoring the judicial system altogether and reverting to a much older, more privative and less reliable form of punitive retribution.

“Federal ruling directing resentencing - Judge William H. Yohn Jr. of the United States District Court for the Eastern District of Pennsylvania upheld the conviction but voided the sentence of death on December 18, 2001”

He was NOT on death row. His supporters have been lying.

Keep him in prison for the rest of his life. He'll never be executed and the best punishment now is for Wesley Cook to die forgotten and unlamented. That's what the cop killer deserves.

This is a load of cr_p. Everyone knows he did it. This is not a case of mistaken identity. This POS should have been put to death years ago.

As Plato pointed out in The Laws, one of the most important reasons to have steadfast law, order, and punishment is to prevent vigilantism.

If this continues, these Leftist judges will only have themselves to blame for the inevitable result.

Sadly it seems as if we don’t have many intelligent judges anymore, at last on the appealate courts.

As I understand it, that decision was appealed by the state. If the appellate court had overturned Judge Yohn's decision, Abu-Jamal's death sentence would have been reinstated.

This thread is about the appellate court's decision, which was to uphold Judge Yohn.
