Code Pink Clashes with City Code Enforcement

A five-day anti-war camp-out at the downtown Marine Recruiting Station (MRS) aboard a Code Pink truck, designed to draw attention to the March 19 five-year anniversary of the Iraq War, turned nasty Tuesday afternoon: An attorney says the city may be using code enforcement to selectively stifle free speech at the Code Pink protest, and a Code Pink activist says she was assaulted by a city of Berkeley code enforcement supervisor.

The large truck dubbed “Green Zone,” adorned with potted plants and trees, has been parked since Monday in front of the Marine Recruiting Station at 64 Shattuck Square. A half-dozen women are staying in the truck round-the-clock, with others joining them to sing, meet and distribute anti-war literature.

The MRS is guarded by four to six—sometimes more—Berkeley police officers, with the number having been augmented since a bomb blast March 6 at the Time Square recruiting office.

Police are also present to keep sidewalks clear. A March 10 bulletin from the city manager to the City Council says, in part “due to the constricted sidewalks, along this segment of Shattuck Avenue, we are enforcing all laws necessary to keep the sidewalk clear at all times. We will maintain access for pedestrians as well as businesses.”

According to Deputy City Manager Lisa Caronna, who spoke to the Planet on Thursday, Code Pink may place nothing on the sidewalk—“No major pieces of furniture on the sidewalk,” Caronna said. “We’ve been very clear with them. Chairs are not going to be allowed.”

Code Enforcement? In Berkeley? I am impressed. Probably since the Pinkers and WCW pulled the BPD into a Review Commission thier Chief ordered them to back off their "neutral" position. No more Mr. Nice Guy!

Whoa! BPD are playing hard-ball...er...doing their job. Glad to see this finally happen.

This should be interesting since Daniel was doing his job and their interactions were obscured from by-standers in the video. Seems the burden of proof will be on Joi.

Absolutely. By the way, the name of this paper should be “The ‘Alternate’ Daily Planet”.

I can’t imagine living in this armpit of the planet. (Are there, honestly, any NORMAL people that live in this berg?)

I don’t know if it’s true or not, but one old cop from the Vietnam era told me that during some of the anti-war protests, the female yippees would conceal razorblades in their hands, jostle cops and slap their own faces to make a bright bloody wound that would serve as the starting gun for a general riot.

Other protesters (not necessarily part of the moonbat wing) would see the poor yippee screaming and covered with blood, assume she was beaten by a cop and charge to her ‘rescue’, resulting in the kind of huge fracas the protesters wanted.

Wouldn’t surprise me if the current batch were just as crazy.

Absolutely. The Bezerkistan Code Pinkers are old pros at this game. It finally came to a head during the Feb 12 massive protests. Previously the BPD policy was to remain neutral.

That’s seriously disturbing.

Let’s hope no one starts using the tactic you describe. Protesters are becoming more and more violent already, both physically and with property damage. A tactic like that may get a cop injured or killed.

Absolutely, crazy is crazy, no matter what year it is!

I, personally, knew folks that did things like that back then. The difference is, however, most of my friends grew up. They don't see things the same way-—at all! They're some of the most conservative people I know. (We feel like we have lots to make up for. Penance, I call it.)

Which would be exactly the result they would be aiming for. No, that’s not precisely true.

What they would love to see happen would be an incident like this, protesters charging to the rescue, a cop go down and other cops respond with firearms, resulting in the serious injury or death of a protester.

Preferably in front of TV cameras and in time for the evening news.

Something that IS different this time? There are folks protesting FOR the military! In the sixties there were no protesters on the other side. The Code Pinkies would have had the protest arena all to themselves. Now, however, there are groups like “Move America Forward”, “Gathering of Eagles”, AND “FReepers”, that represent the majority of us-—the U.S.

I work 60 to 65 hours a week and I can’t afford a used pickup truck I’ve got my eye on to start a small business. How is it these unemployed skanks have a big truck and travel all over the country??

OK, I have been trying to keep my mouth shut over this. I am going to say one thing and then I am done:

Free Speech is used in many manners. But the one manner in which it should never be used in, is in a seditious manner. One can question the Government or support the Government with their Free Speech. There is nothing wrong with that. But when one uses their free speech to break the resolve of the people while we are at war, that is sedition and should be treated as such. We debated the war before we went. We will have plenty of time to debate it when it is over. While we have boots on the ground, I would hope that we ALL would stand with our Troops and their efforts.

It is my understanding that while we had boots on the ground in Vietnam, Minh was funneling Russian and Chinese money into an organization called the CPUA (Communist Party USA). The CPUSA were the ones who organized most of the anti war protest here in the US during the Vietnam war. You can credit some of these people in this organization for breaking the will of the people to fight the war. We did not lose that war on a battle field. We lost it right here in the United States of America.

If we allow people to irresponsibly use our Free Speech, this same thing could happen again. There has to be a line drawn at some point. We have to hold people responsible for their motives to break our resolve. Why is it not sedition, when it is the motive of an organization to break our resolve to win a war? I am done with this because I am not happy and I might be a smart alic and say something I will regret. But let it be known, that in my heart, I look at organizations like Code Pink as seditious traitors to our Nation, our Troops, and myself.

The lovely lady on the left, in the photo below, is the woman who alternates identifying herself as Sammi Joi, Zanne Joi, and perhaps a few other names.

Joi said she was "reaching to get the chair" when she alleges that the code enforcement officer pushed her over. If you will notice, this woman has Volkswagen-sized boobs, which seem to me to alter one's center of gravity considerably. Heck, a good gust of wind would probably throw her off balance (physically - she's obviously always mentally off-balance), landing her face-first into the gutter. Judging from her face in the photo, this wouldn't be the first time she's toppled over from boob-overload.

With your permission, I'd like to use most of what you've written in my next letter addressed to several Federal Authorities.

In every letter I quote 18 USC Chapter 115 - Treason, Sedition, and Subversive Activities , referring specifically to Sec 2388.

Crimes and Criminal Procedure - 18 USC Section 2388

Sec. 2388. Activities affecting armed forces during war

(a) Whoever, when the United States is at war, willfully makes or conveys false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States or to promote the success of its enemies; or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, WILLFULLY OBSTRUCTS THE RECRUITING OR ENLISTMENT SERVICE OF THE UNITED STATES, TO THE INJURY OF THE SERVICE OR THE UNITED STATES, OR ATTEMPTS TO DO SO - Shall be fined under this title or imprisoned not more than twenty years or both. (b) If two or more persons conspire to violate subsection (a) of this section and one or more such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be punished as provided in said subsection (a). (c) Whoever harbors or conceals any person who he knows, or has REASONABLE grounds to believe or suspect, has committed, or is about to commit, an offense under this section, shall be fined under this title or imprisoned not more than ten years, or both.
