The - “he” is legally an Arab American - refers to Obama NOT his father, who was the last to be able to claim an African heritage. Obama’s bloodline has been diluted by his White mother, so he does not qualify as an African American according to American Federal requirements.
His father does, but if, for instance, a father was a mass murderer, does not mean the son is too.
