Testimony continues in trial of border patrol agent

Snippets: On Wednesday, 25-year-old Jorge Dominguez Rivera told a federal jury that his brother was starting to kneel in the act of surrendering when agent Nicholas Corbett struck him in the back of his head or neck, pushed down and shot him – all without provocation.

Corbett's lawyer told jurors in opening statements that the victim, 22-year-old Francisco Javier Dominguez Rivera, of Puebla, Mexico, was threatening to crush Corbett's head with a rock when the agent acted justifiably in self-defense. Corbett is charged with second-degree murder, negligent homicide and manslaughter in the January 2007 shooting near Naco.
