Huckabee vows to defy birthright citizenship

Mike Huckabee wants to amend the Constitution to prevent children born in the U.S. to illegal aliens from automatically becoming American citizens, according to his top immigration surrogate — a radical step no other major presidential candidate has embraced.

Mr. Huckabee, who won last week's Republican Iowa caucuses, promised Minuteman Project founder James Gilchrist that he would force a test case to the Supreme Court to challenge birthright citizenship, and would push Congress to pass a 28th Amendment to the Constitution to remove any doubt.

The former Arkansas governor thinks the case against U.S. Border Patrol agents Ignacio Ramos and Jose Alonso Compean was railroaded, Mr. Gilchrist said. Ramos and Compean are serving lengthy prison sentences for shooting a fleeing drug-smuggling suspect in the buttocks....

Mr. Huckabee has defended his policies on illegal aliens while he was Arkansas governor. He pressed for illegal aliens to gain college tuition benefits, complained about federal immigration raids in his state and declined to have state police enforce immigration laws, although the state legislature gave him the authority to do so....

Ok, so far that is FOUR, FOUR, Constitutional Amendments he has promised, along with the destruction of the IRS, CEOs and their Corporations.

Which is really ironic, given that it's not his call to handle Constitutional amendments.

BTW, what were Fred and Huck saying about that issue in 2006?

Patrick and Sharon O’Laughlin sneak into the United States from Ireland illegally and settle in the the Kennedy sanctuary of Massachusetts. Sharan is eight months pregnant and gives birth to little Shawn hoping he will be their anchor into the New World.

Question:
Who gets little Shawn when they’re deported and Shawn is declared an illegal?
What if Ireland doesn’t accept little Shawn back?
Can we deport him to Mexico?

but getting an amendment thru to thwart the 14th now with so many fresh immigrants here voting along with liberals who love more and more immigrants

We don't need an amendment. Despite what people think, this is not a settled issue of constitutional law, as the Supreme Court has never explicitly ruled on it. Congress could eliminate birthright citizenship in these cases and it would not necessarily be found unconstitutional. It certainly isn't against the plain intent of the amendment, which was to nullify the Dred Scott decision so the Supreme Court couldn't rule against Congress granting citizenship to the slaves.

It isn't necessary to ammend the constitution, because the 14th amendment does not give automatic citizenship to illegal immigrants. Illegal immigrants are subject to the jurisdiction of the country from which they came not the US or any state or territory in the US.

Amendment 14
1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

That's great, but what we need is to simply have Congress clarify the meaning of the amendment for the judges so that there is no ambiguity - since the problem is with the interpretations vomited out by liberal judges, not the amendment itself (which doesn't actually apply to anyone and everyone who manages to be downloaded on US soil).

BTW, what were Fred and Huck saying about that issue in 2006?

I have no idea, and don't care, really.

The problem of anchor babies can be solved by mere legislation, since the 14th Amendment in its last clause gives Congress power to carry out the Amendment by passing "appropriate legislation."

Plus it's obvious Huckabee hasn't read the 14th amendment. I'd like him to explain the meaning of the phrase "and subject to the jurisdiction thereof." Please review my post #92.

Yes, the baby is born here, they get citizenship (or at least the option of citizenship when they turn 18).

The terrorists' baby you mention is no different from the baby of terrorists who are here legally, who may be citizens -- his parentage is not his fault. And maybe we'll put mommy and daddy in jail, we'll raise the kid right and he'll grow up to serve honorably in the US Armed Forces.

At least he is turning in the right direction.

More of a 'feel good' meaningless gesture because he, as President would be near powerless to do much about it. He could try and pressure Congress IF he has much sway with members of his own party but I rather suspect that the U.S. (corporate-owned-and-run) Senate would be even more hostile to Huckaboo than they have been to the overwhelming fed-up conservative populace on the subject of their current unlimited pool of cheap nannys and yard keepers.

His latest on this subject could be easily summed up as being: WAY TOO LITTLE and soon to be WAY TOO LATE. It's going take a lot more than this and being a left-leaning RINO Republican preacher with liberal tendicies to get me to give him a second look.

Which is far more dangerous than all the radical Muslim citizens being raised legally in Dearborn, Michigan.

....We have to decide if they really learned their lesson or are they just giving it lip service. Not an easy task.

In the absense of fool-proof evidence I can only go by his history on the given subject. What he is offering here is simply put 'way too little' with little chance of it getting better. If this is the best he can offer in view of what real Americans are demanding in massive numbers shows me that he simply doesn't get it nor is he likely to get it anytime soon. I simply do not trust this dubious candidate.
