The full legal filing is here: http://www.savage-productions.com/Savage_CAIR_suit.html
The truth-challenged unindicted co-conspirators of the Council on American Islamic Relations have been targeting radio host Michael Savage, as they have targeted so many others before him. They've been pressuring advertisers to stop advertising on his show, and they've been succeeding. Background here.
But Savage, unlike Fox, unlike National Review, unlike so many others, is unwilling to play the dhimmi and kowtow to these lying Islamic supremacist thugs in their continued assaults on the freedom of speech. It's about time that somebody with the resources to do so has fought back.
The text of Savage's suit can be found here. A few highlights:
The conduct of CAIR (in addition to raising money) in violating the copyright interests of Michael Savage was to gain media attention and control so that CAIR would be seen as the moderate voice in the media. In fact CAIR is a radical voice that deliberately attempts to be seen as centrist so that media time goes to CAIR and once on the air, CAIR directs its rhetoric to the benefit of its extremist clients. This is a deliberate tactic and the theft of the copyright material was part of a pattern and practice advancing this tactic.
30.
As set forth herein, CAIR is not a civil rights organization but is instead a political organization designed to advance a political agenda that is directly opposed to the existence of a free society that includes respect and dignity for all people and all religions.
The copyright infringement herein is part of this plan. CAIRs fundamental purpose is to be a lobbyist for foreign interests.

Shouldn’t we all sue CAIR? Like a class action suit? Maybe Freerepublic should sue CAIR? Just wondering.
To: P. James Moriarty
The very heart of the matter --> "The copyright infringement was done to raise funds for CAIR so that it could self perpetuate and
continue to disseminate propaganda on behalf of foreign interests that are opposed to the continued existence of the United States of America as a free nation."
Yes!

I listen to him about once a month. NOw that I know about this lawsuit, Im going to try listening to him at least once a week. I listened to him once. I can't even remember the issue he was discussing, but it stands out in my memory that he found fault with some people that sounded to me like they were fans and supporters of his...even with the issue being considered. He got on some railing tangent even railing against these supporters...perhaps they didn't support him with appropriate enthusiasm...it doesn't matter. I just remember thinking this guy is a nut. So I never took another run at it.

He’s not a nut, he’s just more into expressing his frustration than he is into appeasing fans.
Ok, he’s a little bit nutty. Any radio voice is bound to be nutty. He’s the opposite of rush in that he tells you how bad it is and how bad it’s getting. Rush tells you why you should feel good and be happy about being conservative this day and age.
I think the truth is somewhere in the middle.
To: P. James Moriarty
Therefore CAIR seeks to silence its critics including those who use strong language but do not advocate violence while CAIR itself supports people who use even stronger language and advocate and urge actual violence against innocent civilians; all this under the guise of being a civil rights organization.

Savage is a jerk, but I certainly hope he prevails on this one.
Savage would be great if only he would learn where to draw the line. I love his passion, but his constant barrage of personal insults only show his emotional immaturity.
Hey, Jane Fonda may be a traitor, but she is not bad looking for her age. Calling her a “hag” does *not* help your case (and it probably offends women who are not be as attractive as Jane Fonda). I read that he even called Ann Coulter a hag recently.
Grow up, Michael!

I am a big fan of Michael Savage. I was pleased to hear that several talk show hosts are supporting Michael. I listen to Laura Ingraham and the others, and will make an effort to tune them in more frequently. I am disappointed in Limbaugh and Hannity for their “political correctness” in failing to support Savage. Either they are afraid to support him (they both work for ABC I think), or they are being petty because Savage has had negative comments on them, especially Rush.
But the bottom line is that Savage’s comments are good natured. He has noted more than once that he and others in talk radio thankfully acknowledge Rush’s pioneering work. None the less, Rush and Hannity have gotten a bit tedious and repetitious.

Grow up, Michael! He's too old to change, now. But you're right, he certainly does have a childish streak in him.

This lawsuit will go nowhere. Courts do not handle these types of issues. Copyright law has exceptions for this type of use.

You could be right. The case seems to hinge on Trademark Infringement:
13.
CAIR has misappropriated copyright protected material from Michael Savage and made this material available on its website. This is actionable regardless even if CAIR had a genuine charitable purpose in using Michael Savages material. However, even genuine charities must gain the permission of a copyright holder before using the copyrighted work for fund raising or other purposes.

I think this is a case of “don’t burn your bridges behind you,” which Savage has done with Rush, Sean and O’Reilly. I used to be a big fan, but his constant insults about his competition, and lying about his New York rating, turned me off to him. Nevertheless, I support him in this lawsuit and would love it if he puts this group out of business.
