Frankly, I think these civil liability rulings on the top of a criminal prosecution are bullshit. Pick one or the other, not both.

I tend to agree, one requires "beyond a reasonable doubt" which is substantial, the other "a preponderance of the evidence" which is... um, not. However, in this case I am willing to make an exception. :-))
