Actually, Vatican City is. This guy should've lowered the Mexican flag, attached the Star & Stripes over it, and hoisted both. Then, the ball would've been back in the court of this Hispanic group. And if they chose to act, we'd be discussing their patriotism instead of trying to justify his.

The Vatican IS an INDEPENDENT country, although it only has observer status at the UN.
Do you have problems with hotels that fly foreign flags (many in NYC)? What about the Puerto Rican, St. Pat's and Isreal day parades?
This fool committed trespassing and vandalism. WHY DIDN"T HE BUY HIS OWN MEXICAN FLAG AND THEN DESECRATE IT? In that case, he would be in the right, from a legal standpoint at least.
