Texas State Lawmaker Opposing Deadly Force Bill Shoots Would-Be Thief (Oh, Sweet Irony Alert!)

HOUSTON — A state lawmaker who opposed a bill giving Texans stronger right to defend themselves with deadly force pulled a gun and shot a man he says was trying to steal copper wiring from a construction site, police said Monday. Rep. Borris Miles told police he was fixing a leak on the second floor of the Houston house he's building Sunday night when he heard a noise downstairs and saw two men trying to steal the copper. After Miles confronted the pair, one of the men threw a pocketknife at him, Houston Police spokesman Victor Senties. Miles, a former law enforcement officer, shot the man in the left leg, police said. The wounded suspect was being treated at a Houston hospital. Police were trying to identify the other suspect. Charges of aggravated robbery are pending against the wounded suspect, Senties said. Police said Miles, who is in his freshman term, is licensed to carry a concealed weapon. No charges have been filed against Miles, Senties said. Miles, a Democrat, voted against a bill that gives Texans stronger legal right to defend themselves with deadly force in their homes, vehicles, and workplaces. The so-called "castle doctrine," passed by the Legislature this year, states that a person has no duty to retreat from an intruder before using deadly force. The law goes into effect Sept. 1.

However, in 1998 Rowan was confronted with a teenager who was on his property illegally. Rowan used a gun and wounded the teenager. Rowan was charged with firing a gun he did not legally own. At his trial he claimed he had the right to use whatever means he had to protect himself and his family. Isn’t that the argument defenders of the Second Amendment use? It doesn’t impress the elite who think they will never have to do so themselves, but rely on hired bodyguards.”

Proof positive that politicians DO NOT do what they want to LEGISLATE The People into doing.

This is a given...and even more so in all high-crime minority districts..... This will forever puzzle me.....

Also, one should not overlook the FACT that he is building a 9,200 square foot home in a poor minority district, where many homes lack basic air conditioning......

Hmmmmmmmmmm....do ya think his constituents are sharp enough to raise an eyebrow?

It sounds to me like he is one of those former law enforcement officers that believes that he and his fellow officers are capable of determining when deadly force should be used, but mere citizens are not.

In my experience most law enforcement officers are supportive of the right to keep and bear arms as well as the right to self defense, but there are unfortunately quite a few that are not.

It doesn’t impress the elite who think they will never have to do so themselves, but rely on hired bodyguards.

I'd sure love to see someone introduce laws that would require that hired bodyguards, Secret Service, etc. must carry their weapons unloaded--with a trigger lock engaged.

Now, I wouldn't like to see those laws get passed, but somehow I have a hunch they wouldn't get passed.

In CA, the cops would argue that he was not in any danger upstairs and this Vigilante, playing John Wayne, deliberately and maliciously went downstairs heavily armed and gunned down this poor youth trying to feed his family.

Primary reason for no charges would be self-defense, IMHO; the other guy brought a knife to a gunfight, and the lawmaker had no indication that the knife was the only weapon the mutt had, nor that the other one was unarmed.

To me, it’s a common-sense conclusion, but I won’t say this is what a liberal judge in cahoots with a rogue prosecutor would determine. Seems we’ve seen a lot of that lately, incidentally.

Still, the irony would be even nicer if this guy were indicted and the bill he’s voting against would have protected him.

In Texas you already have the right to defend yourself in this situation...

Dispite Representative Mile’s hypocracy, his voting history and the fact he has a Texas CHL only compounds the issue...

He was still technically in his home (even though it was under renovation/construction) so he had every cause and reason to challenge the criminals, and defend himself with the use of deadly force, per the statutes here in Texas...

The irony is that in his freshman year in the Texas Legislature he voted against provisions that further protected people like us who chose to take on the responsibility to obtain licenses to defend themselves “outside” your home or business...

But in this case, he didn’t even need that license to do what he did...

Unfortunately, I doubt he will take a different tack in the future if he is re-elected...From what I hear, he is a former Houston Police Officer...Not that his viewpoint is indicative of a wider opinion in that organization...

I am not a gun person, but aiming for an extremity like the leg is usually not a good idea is it? Maybe the Representative is a particularly good shot. Or maybe he missed.
