Man who took lewd photos back in U.S.

An illegal immigrant previously deported after being convicted of taking lewd pictures of an Edward Hospital patient is back in the country.

Jose C. Rostro, 26, was convicted of disorderly conduct and unauthorized videotaping after taking digital pictures of a partially dressed, semiconscious patient who was at the Naperville hospital for a procedure after a miscarriage.

Edward officials have confirmed Rostro was working as a surgical support technician at the hospital Oct. 26, 2004, when he took the pictures.

Prosecutors from the DuPage County state's attorney's office attempted to get jail time for Rostro's actions. But a judge sentenced the illegal immigrant to just 20 days of community service work and two years probation.

Two days after that Oct. 19, 2005, sentencing, customs agents took Rostro into custody, and he was deported Nov. 4 to his native country of Mexico, according to Gail Montenegro, spokeswoman for U.S. Immigration and Customs Enforcement.

Now the former Bolingbrook resident is back in the country - and by legal means.

Montenegro said the terms in which Rostro re-entered the country are protected by the Privacy Act. She did confirm, however, that his re-entry is legal.

"We were notified of the situation and looked into and found no violations of immigration law," she said.

There are several waivers that can be applied for entry into the country, including that for marriage or a fiancé's visa, said Mary Lou Cabrera, spokeswoman for the U.S. Citizens and Immigration Services, under the Department of Homeland Security. Each waiver is approved on a case-by-case basis.

According to court documents, Rostro's current address in Romeoville is listed to Angela Barbosa.

When The Sun called the home phone, a woman confirmed that Barbosa is a resident. After asking about Rostro's residency at the Romeoville home, the woman, who declined to identify herself, asked that the press not call back again.

On May 24 a warrant was issued from the DuPage County state's attorney's office for Rostro's arrest for failure to appear on his original sentencing of disorderly conduct and unauthorized videotaping.

Rostro made bail on the $5,000 bond and is scheduled to appear in court Monday.

The female patient Rostro photographed has a civil lawsuit pending against Edward Hospital.
