Another border agent due to start prison term

Another former U.S. Border Patrol agent is due to start a prison term on Monday – this man sentenced for a typographical error that he reported to authorities himself so that the situation could be corrected, according to a new report from Friends of the Border Patrol.

And the case bears similarities to the recent case involving two other Border Patrol agents – Jose Compean and Ignacio Ramos – sentenced to prison for shooting at a drug smuggler as he fled back into Mexico, leaving behind hundreds of pounds of drugs he'd brought into the U.S., said Andy Ramirez, chairman of the FOBP.

For example, the prosecutor who handled both cases against Ramos and Compean and Noe Aleman was U.S. Attorney Johnny Sutton, and the judge was Kathleen Cardone.

The organization said the earlier "miscarriage" of justice happened in 2004, when Aleman, a senior patrol agent, notified authorities of a typographical error on an I-94 immigration visa form while he was in the process of adopting as his daughters his wife's nieces.

The organization said Noe and Isabel Aleman were granted unconditional adoption of Saida, Yessica and Azucena, Mrs. Aleman's nieces, in the El Paso courtroom of Judge Patricia Macias on April 12, 2004, and the couple picked up the children at the El Paso Port of Entry with Juarez, took them home and enrolled them in school.

When following up on some later paperwork, Aleman was surprised to see the children had been allowed into the United States on a document allowing only one business day, instead of the standard 90-day allowance.

Somebody please explain to me what is going on not only with this country but this administration. I know that's more of a rhetorical question.

This story (and I have followed the link to read the whole thing) is unclear. And why would Sutton’s assistants call these children “little whores”?

It looks like this man’s honesty in reporting a typo “made” an easy case for the prosecutor and they decided to nail him as an example. Or, somebody was out to get him.

Why did he adopt these children in the first place? Because they lived in a dangerous area of Jauarez? Because they wanted 3 daughters? Because their own mother couldn’t care for them? Because they were trying to undermine our immigration laws?

On April 25, 2005, a federal jury in El Paso convicted ^ Aleman of conspiracy to defraud the United States and two substantive counts of alien smuggling. From January 5, 2004, to June 15, 2004, in order to circumvent age limits of U.S. immigration and legal adoption policies he attempted to adopt three teenage girls from Mexico, ages fourteen, sixteen and eighteen. Testimony during trial revealed that Aleman provided false testimony to the adoption court in order to adopt them. He also obtained crossing documents for the teenagers through false statements. Those orders purportedly were for the girls to legally enter the United States on March 12, 2004, to attend court hearings for one day. The crossing documents prohibited the girls from staying in the United States past March 12, 2004. Jurors found that Aleman knowingly violated the orders, keeping the girls in the United States after March 12, 2004. Jurors also found that he repeatedly provided false information to the United States and the adoption court regarding their ages, whereabouts and parentage.

This case was investigated by the Department of Homeland Security - Office of Inspector General and Office of Internal Audit together with the Federal Bureau of Investigation. Assistant United States Attorneys J. Brandy Gardes and Stephen Garcia prosecuted this case on behalf of the government.

Ramirez also said Sutton's assistants called the Aleman girls "little whores" during testimony before the grand jury.

That, I would have to see to believe.

Sutton, in an earlier time, would be tarred and feathered.

In Arizona the Border Patrol is “broke” and will not be fixed until a less “compassionate” President is elected. Morale in the Arizona sector is so low it can’t go anywhere but up. Unfortunately, it is also so corrupt it should receive FBI attention. The PC FBI would likely fight any effort to get it involved because there are just too many Latinos on the force. However, given the usual FBI approach to things even if it did begin a major investigation it is likely no one would be brought to trial for four or five years — until the FBI could get a conviction in a plea-bargained case.

Noe would head off to work everyday putting his life on the line in the El Paso sector patrolling the border and stopping illegal aliens, coyotes and drug smugglers. Time passed and they were required to file more papers regarding the immigration visas of the girls. Now here’s where the story takes a wrong turn. It seems that the immigration attorney they hired was incompetent. So much so that the ages of the three girls were listed as 19, 20 and 21.

Things were a complete mess due to this error and the fact that it made all three legal adults and therefore the adoption questionable. The immigration office continued stalling for 6 months on their case and eventually their visa records expired. The girls were listed as illegal aliens.

One day when Noe went to the immigration office to find out what was going on he was arrested on the spot and put in jail with charges of harboring illegal aliens. The family was devastated and the three girls were picked up and placed for deportation.

The girls were sent back across the border and delivered to what they call “a dip” which is a Mexican orphanage. Noe and Isabelle have not seen the girls for over 2 years and Noe has been convicted by Johnny Sutton and now faces 6 months in prison at Yazoo City - the same prison where Ignacio Ramos is being held. He is expected to start his sentence within 30-45 days.

I looked this man and his wife directly in their eyes as they told me their story. I could see the sorrow in them. When I asked Noe about his thoughts on prison he did not show weakness, but only a sense of despair for the three girls and what they are going through. I could feel the sense of loss as they spoke about the lovely family they had while the three girls were with them.

Meet Noe Aleman. In just 9 days, this former Border Patrol agent is scheduled to begin a 6-month prison sentence for conspiracy to defraud the U.S., harboring illegal aliens, and encouraging and inducing aliens to remain in the U.S.

Meet the “illegal aliens” Noe was convicted of harboring…three nieces of his wife, Isabel, whom they legally adopted in April of 2004, with the blessing of their mother, and with hopes of providing them with a better life here in America.

From Noe’s statement via Friends of the Border Patrol: We enrolled our daughters in school as ordered by Judge Macias. At no time could we ever have imagined what would soon take place.

My wife Isabel asked me to look at our I-94 visa to see when the standard 90-day visa would expire so we could renew it. I was surprised, having been too excited when we picked them up at the El Paso Port of Entry with Juarez, MX to note that the document had provided one sole business day for their permission to enter the United States on legal business.

Mr. Ramirez has investigated and informed me that the standard practice when issuing entry visas at the ports of entry is to provide for 90 days.

I reported what I thought was a typo error at the Hawkins (TX) Citizenship and Immigration Services office. I was advised by an immigration attorney while at the CIS office to ask for an adjudication officer and seek an extension of the “parole” as it is known. I did exactly as I was advised, which I was informed by the immigration attorney, who guaranteed me that it would not be a problem having already gone through the adoption process with the Texas State District Court in El Paso.

The Aleman’s family’s reward for Noe contacting immigration officials and attempting to get things straightened out legally?

After a number of contacts with the Hawkins office, I was advised that our visa had been approved and to come and pick up the paperwork, and bring your daughters and identification for them, which we did. I was then arrested and later charged with harboring illegal aliens.

Aleman provides more details. The girls were questioned without counsel by government agents, during which interrogators attempted to get the girls to admit to being abused. Their immigration appeal based on the fact that they are the legally adopted daughters of the Alemans was denied; the girls were subsequently deported. Despite the fact that the girls are, in the eyes of the law, the Aleman’s daughters, the Department of Justice denied all visitation and communication throughout the process.

Aleman was prosecuted by none other than U.S. Attorney Johnny Sutton, with an assist from Assistant U.S. Attorney Deborah Kanof, and with sentencing provided by U.S. District Judge Kathleen Cardone.

If this “team” sounds familiar, you’ve probably heard about the case of Ramos and Compean. And Gilmer Hernandez. And Gary Brugman. And the list goes on.(&David Sipe)

Apparently, the team’s mission is to single out Border Patrol agents and aggressively prosecute and punish them for “crimes” that aren’t even a blip on the radar for anyone else, especially anyone who was in the country illegally in the first place.

I'm even more livid when you consider our government jailed an ICE agent over a paperwork error, deported his children and this is the same government that turns around on a dime and proposes to grant amnesty to 20 million illegal aliens. No amnesty is forthcoming for the victims of Johnny Sutton's flagrant abuse of power.
