Calif. students pay price for refusing to observe pro-homosexual 'Day of Silence'

Dozens of students at three Sacramento, California, area public schools were suspended when they took a stand against a pro-homosexual event -- the "Day of Silence," which was observed nationwide late last month.

Hear This Report

In the Sacramento area, an estimated 3,000 to 4,000 students chose to stay home instead of being confronted with the pro-homosexual message on the Day of Silence. But nearly 50 students who did attend school that day wore clothing and distributed literature highlighting the dangers of homosexuality. Some of these students were sent home, some were suspended, and others were given "Saturday school."

Brad Dacus is president of the Pacific Justice Institute (PJI), which is working to clear the offenses from the students' records. "We're hopeful that we'll be able to reach a positive resolution without having to file a lawsuit. We're still at the early stages," he says.

"Unfortunately, California is like many parts of the country," Dacus points out. "School districts and administrators are often very dogmatic about their liberal agendas," he says.

The head of PJI believes the suspension of students who chose to counter the homosexual message was a clear violation of the Constitution of the United States. "The Constitution protects students from being discriminated against simply because the school district doesn't like what they say or the fact that what they say comes from the Bible," he asserts.

Dacus says the attorneys at PJI are working to have the suspensions rescinded. If that does not happen, however, he says legal action will be necessary, and this case could possibly wind up at the U.S. Supreme Court.

I also notice that many students are not toeing the PC line.

Youth often rebels against their elders. If the elders are spouting PC, one can rebel by not be PC. It's a good thing.

>>So much for freedom of speech.

Ok, no flames, but it’s legality time. This is not a FOS issue. Courts have held that students in school do not have the same FOS rights as do adults even though the school may be held to be a public place.

Typically, students are prohibited from distributing pamphlets and the like, wearing “message” clothing, speaking in such a way as to disturb the class or other activities.

Of course, the rules must be enforced uniformly. They can't prohibit students from distributing anti-homosexuality materiel if pro-homosecuality information is permitted. I would make the argument that this “Day of Silence” is government and government-endorced distribution of pro-homosexauality information, therefore the anti-homosexuality groups had a right to conduct orderly dissemination of their views. Students would have to avoid and “hate speech”, calls to violence, pornography and would be on firmer ground in most states avoiding religious references, but there is a way to be at equal stance in this.

Remember, always sue for mandates to create equality, but even more, sue for huge money damages too. Public committees fold like a cheap double-wide when you sue for big bucks for damages "already suffered."

Also, choose one very polite spokesperson and call the TV stations. Whoever calls the stations first usually gets a story slanted their way,,, but never be a “crazy” on camera.

if your mother went to administrator defending your actions she would be locked up and never see the light of day again. she would be tried by a jury of hand picked queers and found guilty of hate crime

Ya' they could try, but they don't know mom... ;-)

That said, I concur with your statement, but the fuss that would be raised...

However, one thing that they were distributing literature that describes the verifiable health risks associated with homosexuality.

Correct me if I'm wrong, but won't the Supreme Court strike down any hate crime laws as being unconstitutional?

I hope you are right .... but I would just as soon not test that theory out.

We depended on the Supreme Court to strike down the McCain/Feingold attack on the 1st amendment and look where that got us. That was the day that it occured to me that President Bush was not quite so good after all. Why he signed that abomination into law is beyond me.

This is precisely why I call all schools “government indoctrination centers.” There is indoctrination on a wide scale on various topics, from global warming to homosexual rights.

There are many other states that do, not just California.
You need to add the other 48 states to make your comment accurate.

The hell with our second amendment rights. Our first amendment rights are long gone in places like Cali. We owe these brave kids a great deal of respect and honor. They made the freedom honor roll by standing up against these charlatans.

"School districts and administrators are often very dogmatic about their liberal agendas," he says.

Why don't they just claim the students have "school phobia" and send them away?

Last time I checked there were 49 states other than California. And you are commenting upon my accuracy?
