Dear Mr Robinson:
We are writing on behalf of our client, the Democratic National Committee (DNC).
A post by coffee260 on FreeRepublic.com today states that this morning, on the Quinn & Rose show on XM, co-host Quin stated that the DNC chairman, Gov. Howard Dean had called Gov Kathleen Sebelius (D-Kans) around 5:00am on morning after a tornado destroyed the town of Greensburg, Kansas and discussed with here what to say about the tornado and how to blame the war in Iraq and the Bush administration on a slow response to the aftermath.
The statement was made by Mr Quinn, repeated on FreeRepublic, is demonstrably, unequivocally and absolutely false. Gov Dean had no such conversation with Gov Sebelius, ever.
No effort was made by FreeRepublic to contact anyone at the DNC for comment or to check the accuracy of these statements before they were published. FreeRepublic not only repeated this statement, but further stressed that Quinns source was extremely reliable and in a position that would give him direct knowledge of these revelations.
The statements quoted above are false and defamatory, are libelous and slanderous and clearly threaten to interfere with the DNCs operations and ability to solicit support and raise funds by predjuding the organization in the eyes of the Democratic Party supporters and the public. For these reasons, we demand that FreeRepublic immediately cease and desist from Further dissemination of the above quoted statements or any statements similar in substance and immediately post a retraction of these statements in a location on its web pages at least as prominent as that on which the original story appeared.
Please let us know by noon, May 11, 2007, whether you intend to comply with these requests.

How can they sue, and for what grievance? That the FR poster accurately reported another person's comments?
Oh yeah, I know that in the US almost anybody can file suit against almost anybody else for almost anything, but getting a judge to allow a frivolous, groundless, harassment lawsuit to go to trial isn't always the slam dunk that so many people think it is.
I won't deny that there are no doubt an entire corps of liberal judges out there who would jump at the chance to preside over a courtroom rectal exam of FR and JR. But the prospect of going up against the team of high powered lawyers who could be hired by FReeper's contributions to a JR legal defense fund would not be exactly what the aggrieved party had probably envisioned at the outset.
I say let the morons sue. After they're figuratively beaten to a pulp in the courtroom, or more likely beforehand, we can ridicule and mock them to our heart's content just as we usually do most of the time around here anyway.

How does discussing what someone in the media said over the airwaves constitute libel? Answer: it doesn't.

This is like no legalese I've ever seen. It's also like no English I've ever seen.

Besides being illiterate, this sentence does NOT say WHAT is "demonstratively false": the discussion about how to blame the tornado on the Bush administration or the entire phone call.
FR isn't a news outlet, it's a news discussion forum composed of thousands of members. Neither "FR" or it's individual members are legally obligated to confirm the veracity of facts - though morally and intellectually, all members really ought to make a point of double checking facts and most of the FReepers I know DO. Also, to repeat what I said before, discussing what a media personality said on the airwaves does not constitute libel.
The bottom line is the DNC doesn't have a legal case for libel against FR or any of it's members.

Even the original PDF document shows they have no case and are tossing empty threats.
I understand what FR is. I’ve been a member here long enough to know that. My original reply was poorly worded...should have been something like “Why would anyone here bother to contact the DNC about this?”
