Spent 6 days in a jail up here in NH because I wouldn't give a cop my SSN-went to trial and was released.

At the end of the day, how is this action by the police any different than when a cop blocks off a road to allow a fire department to fight a blaze? Or blocking off a street because the town's holding a parade?

We don't have any inalienable right that I see of to use any road at any time no matter the situation.

In 1833, the SCOTUS ruled that the Bill of Rights applied only to the federal government. The Chief Justice was John Marshall who was one of the founders of the republic and along with Madison worked very hard to get it ratified.

Other than the enumerated restrictions on the States, the entire Constitution applies only to the federal government. States have their own Constitutions.

The fact of the matter is that at this moment in time the Bill of Rights apply only to the Federal government unless the SCOTUS has incorporated them via the 14th amendment.

SCOTUS has no power of incorporation.

As the three branches are separate but equal, the judicial branch cannot exceed the jurisdiction of the legislative branch as defined in Article 1, Section 8, Clause 17;
To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of Particular States, and the Acceptance of Congress, become the Seat of the Government of the United States,

In this case, I believe the authorities were wrong but unfortunately within their powers.

I believe the authorities exceeded their powers. In every case of someone suing the police for not protecting them, such as for a slow response time to a 911 call, courts have found police are not liable for failing to protect us. Therefore, they cannot possibly have the authority to prevent us from protecting ourselves.

IMHO, unless the bridge or road itself was unsafe, the police had no right to stop the people. Stopping them because they didn't think they could care for themselves once they'd crossed to the other side smacks of nanny government.

Yes, and this attitude seems to be increasingly widespread. I see it used here in arguments a lot ("where in the Constitution does it say you have the right to...") I just found out that no less a person than Rudy Giuliani, renowned prosecuter, believes that to be true (see my tagline for his quote).

Nice try Jeff, but i believe that in you home state, the Lemuel Penn incident, and US vs. Price has already reached the opposite conclusion in this matter, at least on the issue of travel on public roads.

You summed it up perfectly. The Gretna police, a much smaller force than the one in New Orleans, were trying to head off the types of things that were happening on the other side of the bridge. As an evacuated resident of Gretna, I’m glad they did.

If GOD should decide to drive around America these days; he, she or it would be arrested for no ID, driver's license, registration or proof of insurance.

If he had the baby Jesus with him in the front seat, he would get a citation for no child seat, be arrested and charged with child abuse, and the baby Jesus would wind up in a State-custody foster home.

Doesn't everyone know that all our rights are enumerated in the Constitution? I think we got about 7 or 8 of them. Jeez, what a bunch of maroons. /sarc.

I guess understanding the Constitution ain't required for judges these days.

The problem is the people trying to escape from New Orleans committed their maneuver element without a proper base of fire.

If the police expect to use force to deprive the American people of rights, I don’t thing they will enjoy the result.

As I recall, refugees from the Superdome were trying to cross the bridge into the middle-class bedroom community of Gretna, which had been evacuated just prior to Katrina. Gretna police had remained behind to secure the town and protect the residents' property. The police at the bridge decided that, since there was absolutely nothing in Gretna which could be of any use to the mob of refugees other than what some of them might want to loot and steal, allowing them into Gretna was a recipe that would result in nothing good. If I was a resident of Gretna, I would probably be grateful to my police force.

Your account is basically correct. The only thing I’m not sure about is whether the folks headed across the river were from the Superdome or from somewhere else, perhaps the Civic Center.

The bridge was only blocked after previous bridge crossers had already set the local mall on fire.

Of course, the Socialist Worker and its fans were not happy with the blockage. It appears that some of them still aren’t.
