Someone mentioned there might be a legal difficulty in the U.S. handing off a prisoner of war to be executed by a third party. I hope the delay isn't because of something like that.

I read that too but there is precedent I think- weren't the Nuremburg trials conducted by the new German government?

I thought that technically Saddamn was in Iraqi custody and that we were, in essence, just babysitting the SOB for them?

A "third party" ? Who is the third party, Iran?

Actually Saddam has been "legally" in Iraqi custody since sometime in 2004. After the hand over Iraq requested that the U.S. keep a physical watch over him for safety and security reasons. He is in "physical custody" not "legal custody" by the U.S.
