With all this back and forth about who has 'custody' of Saddam, and has he been turned over or not, and will a US judge tell the military NOT to turn him over, here's what I think happened earlier today. The US officially 'handed' Saddam over to the Iraqi government, however the Iraqi government hasn't physically collected him because they don't have the ability to effectively hold him until execution. Therefore, he is in Iraqi 'custody', but we're just keeping him safe until they 'collect' him, just in time to walk up the stairs to the gallows.
