Bush renominates judges blocked before - (Schumer said "none of the six will be confirmed")

President Bush renominated six previously blocked candidates for federal appeals courts Wednesday, triggering the first real battle with ascendant Democrats since the midterm elections and signaling what could be the start of a fierce two-year struggle over the shape of the federal judiciary.

The move heartened conservatives who worried that Bush would scale back his ambition to move courts to the right and outraged liberals who called it a violation of the spirit of bipartisanship promised since Democrats captured Congress. Both sides saw it as a possible harbinger for the remainder of the Bush presidency, particularly if a Supreme Court vacancy opens.

The decision to send back the six nominees, along with four new candidates for the bench, was a provocative maneuver intended to send a signal that Bush does not plan to cower in the face of an opposition Congress because the Senate almost certainly will not act on them in the lame-duck session that adjourns next month. If Bush wants to keep pushing for these nominations, he will have to submit them again in January, when the Senate reconvenes with Democrats in control.

Now he appears ready to test that proposition. None of the six nominees resubmitted Wednesday received a Senate floor vote: Michael Wallace for the Fifth U.S. Circuit Court of Appeals; William Haynes and Terrence Boyle Jr. for the Fourth Circuit; William Myers and Norman Randy Smith for the Ninth Circuit; and Peter Keisler for the D.C. Circuit.

No time to make it happen, but he could recess appoint. None of the judges nominated now would want to be recess appointed because it would be a dead end for them. Bush could, however, appoint an older judge who would be honored to serve for a year ---- ROBERT BORK.

No kudos for the RINO! It doesn't begin to make up for his participation in opposing Bork, not opposing Ginsberg, making Roberts and Alito pledge not to mess with Roe and total capitulation to obstructionist democrats. He has the blood of 50 million babies on his hands - no he does not get kudos! He is the personification of what is wrong with the GOP. Weak, unprincipled and cowardly!

Seems to me Bush should never have allowed that SOB to Chair the Committee in the first place.

He was warned.

Can't argue with you, except Specter should have done much, much more. President Bush and the RNC showed him much more loyalty than he deserved.

But that's just my opinion down here in the Lone Star State.

I see, it's only bipartisanship if Bush does what Schumer wants. Curious what plans Chuck has to extend bipartisanship. If he had any brains, he would agree to give them a vote, in the spirit of bipartisanship.

Seems to me many freepers and conservatives have accused GW of bending over and preparing to take it from the donks. I guess those that said this are all wrong. Sounds like GW is going to fight the donks over judges. I wonder how many will now apologize to GW and those of us that still support him and knew he would not roll over for the donks? I will not hold my breath.

BTW thank you to those that did not vote, voted for candidates other than the GOP and ABANDONING us like COWARDS. Thank you again because we will now have a very hard time getting an Alito or Roberts type strong conservative candidate on the SCOTUS when there are up to (3) openings in the next two years. Thanks for helping the donks gain power because you will have NO ONE TO BLAME but yourselves, if you did not vote GOP.

Can you hear me big mouth Michell Malkin, crybabies Rich Lowery, Bill Kristol, Michael Savage and Laura Ingraham? You all bashed the GOP for at least a year before the elections, discouraging some voters from voting GOP. Thanks because we will see what a donk controlled Congress will allow with conservative judges.

I'm going to hold off on my apologies to Dubya for a bit, though, until I see what happens on immigration.

I'm as frustrated as you are (then again, maybe not), but I'm not going to blame Laura and a few others for the outcome of the election. President Bush got to the party too late, and didn't use the full force of his bully pulpit.

The myriad of reasons for our losses a few weeks ago have been discussed thoroughly on these boards, so I'll leave it at that.

What part of Oregon you live in? My mom and brother live in Roseburg, a great town. Beautiful area...enjoyed swimmiing, tubing, and fishing in the South Umpqua in my younger days.

I would love to be wrong, but I think a recess appointment would only last until the next Congress is seated in January 2007.

Some he did, yeah. They're called recess appointments and President Bush has made use of them himself. You have a problem with them?

Thank you and thank you too for your serivce to our great country! I live in the mountains about 25 minutes from Grants Pass Oregon, about 1 hour and 20 minutes from Roseburg. Roseburg is quite beautiful. Love it here amongst the mountains and have no plans to leave paradise anytime soon.

Once again, thank you for serving in the best Army in the world!

I just hope President Bush makes a strong case for these judges and doesn't abandon then.
