Carnal Knowledge (Man has sex with deer - outstanding lawyer comes up with excellent defense)

A Minnesota man is charged with having his way with a deer, but he claims it was just venison, the Superior Daily Telegram reports:

Bryan James Hathaway, 20, of Superior faces a misdemeanor charge of sexual gratification with an animal. He is accused of having sex with a dead deer he saw beside Stinson Avenue on Oct. 11.

A motion filed last week by his attorney, public defender Fredric Anderson, argued that because the deer was dead, it was not considered an animal and the charge should be dismissed.

The Smoking Gun has Hathaway's mug shot and a copy of the complaint, which states:

Defining animal to include carcasses would lead to absurd results. At what point of decompose would the carcass cease being an animal? Would picked-over skeletal remains still meet the definition? At death, an animal ceases to be an animal. As Billy Crystal noted in The Princess Bride (1987), "There's a big difference between mostly dead and all dead."

The Telegram quotes Judge Michael Lucci, who is considering the motion: "I’m a little surprised this issue hasn’t been tackled before in another case." Yeah, we're sure this sort of thing comes up all the time up there.

Whatever a man chooses to do with a dead deer in the privacy of his home is his business.

Don't know if I agree with that. From The Smoking Gun:

Hey, it's not his first offense either. From the full article in the Duluth News Tribune:

"The misdemeanor charge carries a maximum penalty of nine months in jail and a fine of up to $10,000. If convicted, Hathaway could serve a prison term of up to two years because of a previous conviction. In April 2005, Hathaway pleaded no contest to one felony charge of mistreatment of an animal for the shooting death of Bambrick, a 26-year-old horse, to have sex with the animal."

Try to follow the guy's train of thought. He was going down the road and there, off to the side, lay a deer. He probably wondered if it was dead or injured.

Some people would just drive on, thinking oh well. Others might stop to see if were still alive. But our boy has completely different thoughts.

Now seriously, who is gonna see a dead deer and think "Boy, that sure looks good, um hmmm"? Just damn.

If this guy killed one animal to have sex with it, he's probably killed a lot more - and who knows if/when he graduates to humans? In serious need of mental help, as well as a jail sentence.
