News from Indiana... Polls ordered to stay open till 8:40pm EST in Delaware County...

3:44 p.m. - Dispute over faulty voting machines heads to court

State Democrats are asking that voters taking advantage of longer polling hours in Delaware County be allowed to cast regular ballots, not provisional ballots.
Chairman Dan Parker of the Indiana Democratic Party responded today after a judge ordered that Delaware County polls stay open until 8:40 p.m. because of technical problems this morning that resulted in delayed openings.

The Republican attorney for the Indiana Election Division has argued that voters in Delaware County must use provisional ballots after the polls close. Provisional ballots are not initially factored into vote totals. They are typically set aside and counted later if necessary.

“I’m calling on Todd Rokita and Republicans to recognize these voters’ fundamental right to cast a real ballot,” Parker said in a prepared statment.

Democrats are arguing that Indiana law does not explicitly prohibit using regular ballots after an extension of the poll hours.

Parker also said there may not enough provisional ballots in Delaware County.

“If there are regular ballots and machines available to be used, voters should not have to vote on a ballot that might not count,” Parker said.

Hugh Hewitt's insider expert, George Smiley, sez:

Nationally tracking turn out in precincts 60 to 80 target precincts and measuring it back against the 2002 and 2004 turn out numbers.

As of this moment we have a 5% advantage compared to Dem and GOP. That is up from a 1/2 percentage voter turn out advantage from an hour ago.

and


GOP base precincts are turning out higher than Dem base precincts:

MD 3% higher

MO 2% higher

VA 7% higher

Yep, although the Harris race is pretty obvious, it's gotta be exit polls for any of the close ones. Absolutely ridiculous. Didn't they learn anything from the 2004 election?

The Panhandle's the most conservative part of the state. But to be honest, even though polls can be inaccurate? If Katherine Harris pulls off a win, it'll be a miracle just short of the Second Coming or the Cubs winning a World Series. And the screams of "fraud" from the Rats would be legendary.

I am in the 9th. I voted at 7am and I was the 61st to cast a ballot in the first hour.

Don't be us negative. Alot of people in your precinct polling location may have voted absentee.

Katherine Harris lost six months ago.

This was one of the most absurd throwaways of a winnable seat I could ever imagine.

What's wrong with the Florida GOP that they could not nominate a proper candidate?

Hope the networks cannot project any of the congressional races in KY or IN in the dead heat races -- the longer they cannot call them, the better for us nationwide. IMHO.
