Ah, I see how it works now. So, Foley's name stays on the ballot but the Foley votes are really votes for some as-yet-unknown replacement nominee. Interesting. I'd call that a Toss Up.

Well, it wouldn't be for some "to-be-named" candidate. The law says that the party has to name a candidate before the election but Foley's name stays on the ballot.

I'm adding to this by saying that Gov. Bush can call for a special election to fill Foley's vacated seat for the remainder of his term (the lame duck session after the November recess). On that ballot, the actual candidate's name will appear. If Bush makes that election also on Nov. 7, then there will be two ballots -- one with Foley's name and the other with the real name of the candidate. Then you'd coordinate the campaign message to make clear who the candidate is and how the balloting will work.

Unless the primary results have not yet been certified, and then Jeb's name goes on the ballot. But they probably have been. The SOS's website calls the results "official."
