A federal district judge in Detroit has ruled that the Bush administration's NSA surveillance of phone conversations is unconstitutional.

UPDATE: I’ve started reading the opinion. The first thing that strikes me is that how Judge dismissed the government’s claim that the Plaintiff’s could not prove their conversations were being monitored. She relied on the affidavits of lawyers and a journalist who admitted they had contacts with terrorist organizations and people accused of helping the insurgency in Iraq. So when faced with admissions of people that they are in contact with alleged terrorist organizations - the Judge ordered the government to stop listening. Why? Because it impeded their ability to conduct research, engage in advocacy, interact with sources, and represent clients. The Judge also noted the financial “hardships” these Plaintiffs would face in having to travel to meet these people. This apparently trumps national security. This is insanity.

I thought our legislatures were going to put an end to this judge shopping but it only seems to be getting worse. Now these crackpot organizations file hundreds of lawsuits throughout the country in hopes to land that liberal judge or two and throw out the rest. The ACLU knew from the moment this judge got this case they won but this judge gave them a bonus by putting the NSA out of business instead of the usual stay pending appeal.

It's more than a bit sad to see that it takes the Judiciary to protect our rights. The GOP elected is no more a friend to liberty than the 'crats are in Congress.

And there's a lot of utter cowards who are happy to let the Government do anything they want, even when it breaks the law or violates the Bill of Rights, as long as they get told they'll ALL DIE otherwise. A lot of those people posted on this thread already, in fact. People who'll lap up any crap they're told by the GOVUSA as long as it's not a 'crat in charge. Pathetic, really.

Yeah, this could be overturned at the next level, but the GOVUSA has admitted they know they're conducting warrantless wiretaps *openly* in violation of FISA. Either change FISA or *stop breaking the law*. How hard is that? Congress can authorize warantless searches!

Of course a liberal back then isn't much left of your average Republican these days.

defended Mayor Coleman Young's efforts to integrate city government in the mid-1970s, ruled against Pope and Detroit in 1993, declaring unconstitutional a program that reserved municipal contracts for minority vendors.

It appears she can separate her politics from the law.

This reminds me of the attacks on the judge who threw-out an anti-smoking EPA report. The anti-smoking lobby paraded around the fact that he had previously been a lobbyist for the tobacco industry, but conveniently left out the fact that he had decided against the industry in another important case.

But Congress will want to be in the loop. And Congress has already shown that it simply cannot be trusted to keep ANYTHING confidential, even in matters of national security.

The President is specifically tasked with protecting the country. He should be able to make a judgment as to when to invoke FISA and when FISA would be detrimental.

Your "rights" are not being violated by warrantless wire-taps, unless you're talking to al-Qaeda.

But if Hillary was authorizing the NSA to intercept international phone calls to the US originating from known terrorist-affiliated phone numbers overseas, I certainly wouldn't object.

Given the FBI files case, do you really think that's all she'd be intercepting?
