Paper on America's love affair with the SWAT team and "dynamic entry" raids.
See scary accompanying map of botched no-knocks and other SWAT-style raids.
Cats are predatory animals. All they have to do is claim the cats are killing the birds they keep on their property. Or they can claim the anti-freeze is to keep away skunks, racoons, or rats. Maybe the DA disagrees, if so, then it is a case for a jury to decide.
Maliciously neglecting, harming, killing or poisoning an animal can be charged as a felony and may carry a penalty of one year or more in state prison and/or a $20,000 fine.
I live in Omaha Ne. we have three police unions one white, one black & the Hispanic officers association.
The past editor of the F.O.P. wrote a column in the "Shield" that disagreed with a position taken by the Black police unions leadership. The president of the black union then gave out the unlisted phone number & unlisted address on a public access cable of the white officer & encouraged the audience to give the white officer "a phone call" .
The result was a series of phone threats against the white officer & his family. When the white officer confronted the president of the black police union demanding what right he had to recklessly endanger his family , it took several other officer including a field supervisor to keep the black police officer from drawing HIS weapon & SHOOTING the white officer .
The black officer was given a short suspension & a written reprimand . Should I really trust this collection of dolts?
WOULD YOU?
Lame assed excuses for the creatins is NOT going to get them off. They don't keep birds and they bragged about poisoning the animals to other neighbors. These people
are sick ... and so is ANYONE who would condone what they did. The law does NOT recognize domestic cats as 'predatory animals WHO KILL LIVESTOCK" Skunks and raccons are protected species and poisoning them is also ILLEGAL.
In America, juries decide those things, not the plaintiffs. Let us know how it turns out.
I went back and read what the excerpt that you posted. That's not what it says. It says "predatory animals or livestock-killing dogs" and does not say that the predatory animals have to prey on livestock. It says dogs have to be preying on livestock to be covered under the exception to be poisoned. All other predatory animals are fair game as long as the sign-posting requirement is met. Did they post any signs?
No they did NOT post signs. This is NOT a ranch it is a house in the suburbs ... no livestock is allowed here. The houses back up to the San Jouquin river where there is a lot of wildlife ... ALL of it protected. Once again domestic cats are NOT recognized as predatory animals in the sense that the law refers too anymore than my neighbors teacup poodle is.
and also you are missing the point. These people did NOT set out poison because they had a predator problem or even had a cat pooping in their yard problem. There are no backyards here. The decks overhang a PUBLIC river. Wildlife like ducks and geese live in the rushes and reeds under the decks and it is ILLEGAL to molest them. That includes the neighborhood pets. They poisoned the cats to get back at the neighbors as part of the years long feud we all have been having.
Are the cats preying on protected wildlife? It sounds dangerous for the cats to be out roaming around in that area.
DOMESTIC CAT PREDATION ON BIRDS AND OTHER WILDLIFE
And: The Rights (and Wrongs) of Cats
According to [California] Fish and Game, stray cat populations threaten a litany of endangered species: California clapper rail, San Clemente Island loggerhead shrike, Pacific pocket mouse, riparian brush rabbit, salt marsh harvest mouse, Alameda whipsnake, and California least tern.
The neighborhood cats are not prevented from preying on protected wildlife? That's not good.
Oh Oh the phone rang while I was typing this ... it was my neighbor ... the investigating officer called to inform us that the evil neighbors have been charged ... with TWO FELONIES. Justice may yet prevail
I now suspect that you're making this up! From your own posting supposedly from the DA:
"596. Every person who, without the consent of the owner, willfully administers poison to any animal, the property of another, or exposes any poisonous substance, with the intent that the same shall be taken or swallowed by any such animal, is guilty of a misdemeanor.
Here's a similar case. Three counts charged; one plea bargain, two dismissed.
Contra Costa County Animal Services 925 335-8300 reference police report number A06-16062 ... care to call me a liar again ahole
I sent him a rather scathing e-mail on that after I heard it also. He actually responded. I understand he likes playing with his Blackberry - it mentally adds 4 inches to his height.
You should try it.
The link is on the City of Albuquerque website.
Re Post 113 ... OK
I'd laugh if it weren't so tragically true.
I live near Albuquerque, NM, which is prominently represented in this summary of these sorts of activities.
Plenty to read here, so don't lose patience.
Thanks for the ping.
